Bumping this thread again.

Has the California FTB rules changed recently? I recall the definition of "doing business as" used to include explicitly "a member or partner resident in California".
Now when I look at this page, I don't see the residency part. https://www.ftb.ca.gov/file/bu...

Does this definition allow us to draw passive income from Out of state LLCs (setup to own rentals)?

@Mary M. I don't really mind working this out with Tenant if they are being reasonable. I have already offered them $200 (arguably I could go a bit higher but not to $1500). It's pretty clear to me at this point they are not being honest in their request and the problem in appeasing them is that they probably going to do this again next month (or the next) over something else.

Note that they haven't submitted any itemized receipts, just transaction history showing expenditures at Sam's club/walmart, etc. Not all of that would be perishable of course. Also, some of the expenses are after they raised the work order. Why would anyone stock up on groceries with a broken fridge?

@Nathan Gesner @Eric Selhorn Thanks for the replies.

Agree with other points made above that Eviction is probably going to be more costly than what tenant is asking and the PM stands to gain by eviction proceedings, re-leasing costs, etc.

Just trying to weigh my options here.

 Think about this for a second - do you REALLY think a judge is going to evict them over this??  Really? 

It's not about the fridge anymore, which is fixed. They are not paying rent which is violation of lease. They can pay rent and negotiate a credit.

Although I would say I have no experience with evictions and hence do not say what a judge would say in this situation.

My property manager has given them couple of days to pay rent (minus the credit I offered). If they can't pay, unfortunately we would need to hold them accountable in violation of the lease.

yeah, I do realize 10 days without a fridge could be inconvenient but we acted on this immediately and this was the earliest a service technician could come. The other option was to through away that fridge and buy a new one (faster but definitely much more expensive).

 This is partly the reason I offered to compensate for a week's grocery but $1500 is just BS.

Hi BP Folks,

One of my unit is rented out to a tenant with a refrigerator. Recently, the refrigerator broke down and we got it fixed in about 10 days (the earliest we could get a technician to the house). Now, the tenant is asking for almost $1500 in compensation for the loss of food and groceries and are holding up the rent for this month. Note that this amount is even higher than the monthly rent! Also, not to mention that's its a regular size appliance which can't possibly hold this much of food.

I know I am obligated to compensate for their loss but as a goodwill, I still wanted to do something about it (in addition to getting the appliance repaired). However, this unreasonable ask has completely changed my mindset about the whole topic. 

Wondering what other experience folks have to say about this. I do realize that she may be just looking for reasons to get out of the lease early (which might be a better option over a disgruntled tenant).

@Jay Compton, @John Patton I have been hearing negative view on Center Point. Curious to know what exactly is going on there? Especially since lot of neighborhoods are revitalizing fast near Birmingham IMO.

@Matthew Rolf I am looking for something in $250-$300k price range and would prefer to have rents $2000 and above.

Some of the areas that I am trying to research are east downtown, 5th ward, south acres and eastern Houston.
