i am reading the court documents regarding an HOA foreclosure property that i am interested in and i noticed that there is a line that says" Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale"

can the tenant, property manager, family of the owner, MY FRIENDS, claim this money? can i put a stop to it if i win the bid ?

i have seen plenty of stories and heard that the Chinese and Brazilians ,are buying properties in the US and paying cash. i am just curious to know ,if it is really true  that they are paying cash ? Can they qualify for a loan if they don't live or work in the US ?

we just know it is paid by cash verbally because i heard so. i want to see proof of some means. now i understand that is personal and private info with the bank, but i wanted to know if there is some government agency that i can refer to. i can do that math when it comes to the doc stamps and figure out what the purchase price is.

i am tired of hearing go a title search . how the heck is a realtor going to help me with that info. i already did my own title search , i want assurance by double checking another source. i am asking for a source. i am tired of people saying you should do a title search. i think the average joe knows how important a title search is , but i was just wondering if there is another source that we can go to directly for the info i am seeking.

i am looking to invest in a property and i wanted to know if there is a way to see a disclosure report for example from the county or state. i can get an idea if i see no mortgage recorded, but what about the actual transfer history. i think the money that was used to purchase the house was buy the house was wired from overseas, so besides the bank what are the other ways i can tell.

do extinct items related to a mortgage companies in Florida ? more specifically, i mean what happens if a mortgage company did not get their lien recorded, and someone buys a house from the court, and then the bank wants to foreclose even though their lien is not record .

hi Leigh, i have looked the the previous deed and the transfer does have the right name. i am being cautious now that you told me if the name is wrong, the mortgage will still stand. in orange county Florida, you can only search via name and not parcel number, book , block etc. i think the records office here needs to be improved.

be careful with some title companies that you use. the owner's for these companies will invest and bid on the same house that you want to buy. it is like stealing intellectual knowledge.

I can't seem to find a good discussion on " sources"that are used for a title search . i know they are some people like @Wayne Brooks who would perhaps not order a title search because of his level of experience, and the respect he has earned in the BP community. While a few of use will fork out between $35 to $150 for a title search, we will also hear stories like title searching in fl is a proprietary method only available to title search companies , and this is far from the truth. the average Joe can see the same thing, and go to the same websites that these title companies fight hard to keep from our knowledge.  please list all the government resources that a person can use to find the same info a title search company will use.

Some of you may have been fearless or fearful on your first attempt at buying through the court auction.i made a deposit and I am prepared to spend up to 30k ,and then pay off the past due delinquent taxes. I did my own title search here in FL and the two resources I looked at are the tax collector and comptroller. The search has been easy because the person's name is unique,only one such person in the county and the property only had one prior owner. Wouldn't you agree that makes title searching easy, since the chain of title isn't long . I was privy to some info in confidence by the nanny who is my friend . The owner lives in Europe and his property manager doesn't seem to be doing their job because the taxes have not been paid in two years , and the HOA foreclosure date is set. The HOA judgement is 8k. There is no mortgage on the property which the nanny confirmed . If I didn't know the nanny I would not bid and would walk away from this kind of transaction. What are your thoughts ? What other resources besides the comptroller and tax collector should I check? Can I negotiate the delinquent property taxes that is due for 2014 ,2015 and now 2016 ?
