Post: Tenants should pay for damage, right?

Late last night I received a call from one of my tenants telling me that one of the other units had a fire in their apartment (this is a 4-plex) 2 days ago. She said there was an explosion and she didn't know what happened but 2 of the fire extinguishers outside the building have been used. She said that she saw them pulling out carpet, etc. I will be going there tomorrow to do an inspection. I tried to contact the tenants and asked if something happened but they won't answer and I'm sure they are trying to conceal whatever damage I might find before I get there tomorrow. I can charge them for everything they damaged or do I need to go through my insurance company? It's petty but can I charge them for the fire extinguishers?

I have a fourplex and the 2 downstairs units have their own small yards. One of the tenants asked if I could have a big tree in their yard chopped down because she thinks there may be a wasp nest. I hired a gardener to come and remove the tree and peeked next door at the yard and it was covered with tall weeds so I asked them to go and pull out all the weeds and spray weed killer. The tenant found out that all the weeds were pulled and that I did not give him notice about anyone entering his yard. This was in the end of June and on Oct 8, he called the Police Dept to file a report that his garden tools were stolen and he said that I purposely had someone come in to take his things to harass him. Should I have gotten his permission to enter the backyard?

I haven't notified my insurance company yet because I actually haven't even been served the summons. He filed the lawsuit on July 2 but whenever they come to serve me, I'm at work. I saw a copy of it online. Should I let the insurance company know about it now? My tenant is very smart but also sneaky. He also has no money so he's looking for a big financial gain.

Thank you everyone for your advice. We went to court again today and finalized the settlement. Nothing really changed from the terms I posted earlier except that we wrote in that if he won't drop the civil suit, then I will counter for the rest of the money he owes me. He was adamant that he will not drop the civil suit and if I won't settle, he will further pursue a jury trial. Mentally and physically I am drained from all this. My children are suffering because I have to spend all my time working on getting information together for my lawyer and I can't spend time with them. If this actually went to a jury trial, it's going to last months and my lawyers fees would just continue to grow. My lawyer advised that we just settle and let my insurance company take care of the civil suit. I felt like that was the best route to go. The tenant made a comment that I don't have to worry because my insurance company will pay him what he's owed. Frankly, he's owed nothing but I know some insurance companies will just pay out to avoid spending alot of time on these cases.

He files in his civil suit that the apartment is not legally habitable. The craziness of this is that if it isn't habitable, why did he propose on his settlement terms that he not get evicted and when I said no, he then ask if he could stay for several months so he can pack and find a place? If it's so uninhabitable, wouldn't you want to leave asap?

He claims he is subjected to lead-based paint, extensive mold, faulty plumbing, fire hazards and basic sanitation.

Lead-based paint? It originally may have had lead-based paint when it was first built but I'm sure the building have been painted over many times since the 60's.

Extensive mold? In 2011 he had mold growing over his shower. I looked at it and it seemed to me that it was a housekeeping issue. It was just above the shower area and no where else in the bathroom. I will admit that I did let it go for a good 6 months before I went back to look at it and then I had all the sheet rock above the shower replaced. He said he was satisfied.

Faulty Plumbing? After I posted the 3 days notice to pay or quit on his door, he puts in a service request and says the water goes from freezing to scalding in his shower. Had a plumber come out and he said he feels a slight fluctuation in the water when he has the bathroom faucet also running and he's flushing to toilet. Recommended that I change out the valves to better regulate the water temperature. Had him test all the 4 units and he said he didn't see a problem but would recommend to fix in all units because they all have the original plumbing.

Fire Hazards? Not sure what he's referring to but could be that one of the tenants has alot of stuff stored in his garage.

Basic Sanitation? One of the households in the building constantly throws trash under the stairwell that he has to walk past everyday. I have told these people so many times to clean up after themselves. I recently sent them a notice and told them if I go by and I see trash under there again because they throw garbage bags there, I will send them a notice to move.

Sorry this is so long. Do you think I should have the plumbing fixed now or just wait until this guy moves out?

One last thing, he said that I hired gardeners who purposely came to steal his things in the yard. He never told me about this and the only reason I know is he just filed a police report about it 2 weeks ago and the officer who wrote the report called me about it. The last time the gardener was there was back in June and he now decides to file a police report over 3 month later. Do they come any crazier?

The lawyer I have specifically only represnts LL's and has done thousands of these cases. So we went out in the hallway to settle and my lawyer wrote up everything but tenant said he will not drop the civil suit against me. he made a comment that this case is worth alot of money to him. The settlement states that he is to pay $3000 towards back rent and the rent for Nov by Oct 31. Then for the next couple of months he is staying, he must pay by the 1st of each month or he would violate the settlement agreement and have to move immediately.

If he won't drop the civil suit, then I don't want to settle. What I am unclear of is can I back out now? I haven't signed anything and nothing has been filed with the court because this all happened after hours on Friday and court is closed until Tuesday since Monday is a holiday. Also if the tenant can't provide the judge with all the documentation necessary for a jury trial by Tuesday, would the judge dismiss it and say this cannot go to trial? I can't get a hold of my lawyer since it is the weekend and I don't know if he's working Monday. I feel like I'm on pins and needles.

I have an attorney but the tenant answered the UD filing and then we went to court yesterday. Essentially we went before the judge and he said to try and settle the matter ourselves. It took 8 hours because my tenant said he did not like my settlement terms and wanted to go ahead and have a jury trial. The judge sent us over to see another judge and then he pretty much told my tenant that doing a jury trial is probably not in his best interest and listed all the reasons. As we walked out of the courtroom, he said "let's settle this" and I agreed. My lawyer wrote us the terms of the settlement which at the time I thought was ok but as I went home and discussed this with family members, I really feel like it was a win situation for him and not so much for me. Reason being he is representing himself and hasn't had to spend a dime on attorney's fee (I spent close to $4K) and the settlement terms was that he would pay me back less than 1/3 of the back rent he owes me and then stay a few months more to pack up to more but pay me rent while he is there. On top of that he already filed a lawsuit against me that he says he just can't drop. So essentially, he doesn't pay me back for all the rent he owes (close to $10K), doesn't move out for 3 months and one top of that he's suing me which will cost me more in attorney's fees. My option is to just settle and deal with this or force him to do a jury trial which I highly doubt he would be prepared for one with no legal representation. What would you do?

The front of my property and the laundry room always seems to have garbage accumulate. This is a fourplex so there is just a laundry room with a washer and dryer but the tenants seem to always leave their empty bottle laying around.

I was thinking of having one of the tenants, if they agree, to sweep the front on a weekly basis and also make sure the laundry room is clean for a $50 rent reduction. Is that a good idea? Other options would be to pay them $50/month or just find someone else altogether. Any advice?

I have a tenant that filed a lawsuit against me. This all started because he owed me 8 months in rent due to not having a job. I let it go for 4 months before I gave him a Notice to Pay or Quit. Didn't pay so the Unlawful Detainer was filed and then he went to the courts 4 days later and filed an unlimited civil suit against me for habitability, etc. In all the months with no rent, he never once said anything about withholding rent for habitability but always because he didn't have the money. Everything he is sueing me for are issues that are from the past and have already been corrected between 2010 and 2011. Is there some sort of statue of limitation that makes it so he can't go back and sue me? I know he's just doing it because he's mad that I filed the Unlawer Detainer against him.
