I have a person that is on a lot of psychiatric drugs. Or at least he used to be but now for one reason or another refuses to take them. He even tried to burn down my building while attempting to kill himself. See my other post on that.

How can you legally prevent something like that from happening again? Can I legally ask people to list all the medications they are on  as part of their rental application?

Most of the people seems to be OK all the way until they decide to get a gun and start shooting people at the movie theaters.

I had an applicant like that who was on disability (age 33) with a great credit. He didn't look sick at all so I was wondering what his disability was. I lucked with him out because his criminal report showed that up until 6 months ago he was serving 11 years of a 13 years sentence for assault and battery of his wife (including throwing acid at her face). We have a strict no-eviction and no criminal background policy at my place.

Don be stingy. Save yourself potential troubles and run criminal background check on your future tenants.

I had worse. I purchased a 21 unit apartment complex with two of the tenants waiting for the sheriff to evict them. The complex consists of two building with 2 different street addresses. Unit 1 to 10 are on 517 address and unit 11 to 21 are on 511 address.

The sheriff came to kick out the tenant and he told him that the address on the order was wrong and he should go to the other building. Of course there is no such unit number at the other building. The sheriff left without removing him from the premises. 

The whole process had to be refiled. When the unit was emptied I had to spend $900 for exterminator on this unit and the two directly attached to it. He was breeding cockroaches for sport.

I own an out of state SFR property that is managed by Flex Realty Property Management in Toledo OH.

I just received a fine from BAT (Beautification Action Team) stating that I failed to abate something.

I am not sure what but I owe them $470.00 for 1.58BAT units whatever that one is. That is $300.00 per BAT unit mind you. I cannot even understand for what are they charging me for nor what I was supposed to fix. To quote them verbatim: "As an owner on record at the time of service of the referenced address, you failed to abate a nuisance at the stated address."

The notice comes with 0.5% monthly interest and the following threat: "Failure to pay will result in the cost becoming a tax lien against the property or a personal debt turned over to a collection agency."  

I tried calling them and left multiple messages but no one returned my call.

The only thing I understood from this letter is that they inspected the site on Aug 20, 2015 and on the very next day (August 21, 2015) at 11:15 am BAT performed something. I was not informed about the problem but even if I was one cannot possibly expect to take an action with less than 24 hrs. notice.

I am not sure how this city operates but here in California we were given notice and then we were given 10-15 days to fix the problem (some of that time is eaten by the USPS to deliver the mail).

I understand that the city has laws to protect it's citizens from bad landlords/neighbors and fines need to be levied on people that do not care to maintain their properties but at least tell me what I should be paying you for. Take a picture, explain what the problem was so it will be avoided in the future. You cannot go around the city and charge people for service they have not ordered. "Here I replaced the tires on your car. That would be $2,000.00. You should be grateful for me doing that. Now pay up or we are going to send the bill to a collection agency. What? you didn't know you had a problem? We knew about it. We learned about it 12 hours ago. You should have read our minds and fix it before we came back to do it for you. Look how much more beautiful your car is now. Isn't it great. Welcome to the beautiful city of Toledo where we take a good care of each other." 

Is this a new way for the city to steal from the homeowners so they can line up the pockets of the city councils and the mayor? If it is, I don't really like it.

Am I been targeted because I am out of state owner and usually no one gives a frack about it? Are there any other out of state owners receiving similar invoices?

The guy got out. I tried offering him cash for keys but he refused. The guy is delusional: he thinks he can find himself a job and get current on his rent. Yesterday his 3 day notice expired and we filed with the courts today. There is no expedited procedure and there is no way to get a TRO faster than evicting him. The faster ones are reserved for TRO between family members only. 

His excuse for what he did was that he was cold and that is why he turned on the gas!!! It is 110F in the desert!!! How can you be cold!! The police seems to buy that because they kept him only for 36 hrs.

Today he was out of his mind again and the officers only made him take his medications and left without picking him up.

I just purchased a 21 unit apartment complex with a lot of problems. I started cleaning it up - 3 unit evicted in the first month and two more in the way - all of them professional tenants. But this month I got a new completely different problem: a suicidal tenant.

The guy was a friend of the previous manager and was moved in without any background checks or any security deposits. When they moved him in, the guy was or was about to get divorced. 

Fast forward several months later and we have a guy that is unemployed, drunk or on drugs exposing himself to the other tenants. The police have picked him up several times but let him go after 12-24 hrs. When he was back, he was threatening people but now people no longer want to call the police because the police let him out every time.

Yesterday, he decided to take his life. Since he didn't have electricity (he stopped paying utilities several months earlier) he tried doing it by using the stove (water and gas are paid by me - the owner). The other tenants smelled gas and reported him to the police and they picked him up (again). I was told they are going to keep him for 72 hours.

I have already given him a 3 day notice to pay or quit (because he didn't pay his rent as well) but is there anything else I can do to expedite his eviction.  I had two tenants calling me about him - both of them afraid about the well-being of their kids and ready to break their lease and fly away. The standard eviction procedure takes over 45 days here and if this continues, I may be an owner of a completely empty apartment complex way before that.

On the top of it this is the Communist State of California where tenants have more rights than the property owner. The only bright spot is that this is not in a rent-controlled property.

I am going to try to offer him cash for keys but what if he does not want to move? What type of documents should I ask him to sign so I would not be open to lawsuit after that? 

Any OTHER suggestions?

@Kevin Young What bank are you using and how do you create the deposit slips for your bank. Do you order them online?

After pushing a bit more, I got some more information on the issue. They did serve the tenant a 3 day notice to pay or quit but the tenant have not responded yet.

Yes, unfortunately, I did. Their owner of the company is a great guy but the people working for him - not so much. A member here told me that they are the best in Toledo, OH. I guess one should not have too high standards.

Communication is a problem. The water bill gets billed to me but for some reason it is received by their office. Despite my request to send me the bill - I have not received a single copy of the bill and I owned the place for over 6 months. Supposedly, the tenant gets charged back for it but it took over 5 months to adjust, readjust and re-readjust the accounting.

Now (July 14th), I just received an e-mail (I was about to call them today) telling me that the tenant is late on his payments. I am still waiting to see if they have served him with a 3 day notice on 6th as they were supposed to(stated in the lease agreement). I'll keep you posted with the progress but my advice is - don't do it. I only did it because they had a lease purchase agreement with a tenant that was trying to build his credit and start a family. I was hoping that this would be a no-problem tenant but in this case even a lease purchase agreement is not enough to make people pay their rent.

Last month he was late and because of it, the management company decided that is is OK to wait till the middle of the month before taking any actions. I cannot understand the logic here!? If you want a better outcome you should probably call them twice a month to remind them how to do their job.

I am looking for someone that can deliver a 3 day notice to pay or quit to one of my tenants in Barstow.

I am out of area landlord and I cannot drive to there in the next 10 days so I am looking for a local person that can print my notice and deliver it to my tenant living near by the intersection of Barstow St and E. Fredricks St.

I am willing to pay for the effort. Please contact me with your price if you are interested.
