Curious what you would do in this situation: Ive spent the last 4 years getting a permit to build an ADU for a property I own in California. I got a HELOC for 200K to build it a few years ago but the permit process was such a headache and the county was so nit picky that I didn't get the permit until recently. Meanwhile prices have gone up substantially and now the quotes to build this small dwelling are 450k (or 350k without materials). I can't get a loan for the rest (unless there is some type of loan that would lend to me being unemployed for the last 2 + years). It would rent for about 2500 a month. Currently I make about 800$ in cash flow over monthly expenses on the main dwelling. I have a lot of equity now that prices went up on real estate so much so: at this point do I sell? Exchange? Try to find more money to borrow to build the ADU? Bail on the ADU project (and the 30K in permit costs and 4 years of headache trying to get the project to happen)? Is there some obvious way to got that I am missing? Thanks!

Thank you to all of you who responded. I don't think I want to sell as its so hard to get into the market in Ca, (and I have worked hard to do so) although I will certainly think about it. I definitely have had a buy and hold strategy so far.

@Albert Ng Property manager was happy to place her with no co-signer but I wasn't because although her income (self employed) was high her business expenses were high too. She does has a landscape design business and so I think income must have been heavily affected. But related to initial screening in January I asked for a co-signer. Said co-signer didn't feel comfortable with the application (ss # etc) and tenant called and asked if she could give double deposit and checks for a year in advance. I thought this was reasonable at the time. When her business checks started bouncing before Covid she paid each time through online deposit a few weeks later, then gave me a new set of checks from different account. I think she made a new account just for those checks and there is no $ in it at all. I know that bouncing checks is illegal so not sure what that means in terms of leverage for me to get paid.

Ive thankfully never had to go through an eviction. I think this person is smart enough and resourced enough to not want an eviction on their record, but she is also probably smart enough to rip me off pretty good in the mean time. So I just need to use this time where I can't do much to get smarter.

I have a non paying tenant in Oakland, Ca. She was vetted and placed by a property manager in the area in January and then I decided to self manage after that until it got too confusing (in May).  She let me know in April she would not pay related to corona virus but since then has not informed me one way or the other and has not responded to inquiries about making a payment plan (and is 3 months behind). My tenant told me she would pay $4000 in May and then did not deposit it. At that time I got a property manager to help me with my situation because I didn't want to do anything wrong. She told him she would pay $4000 in June and then did not. She apparently had a baby in June as well. She has been non responsive to both the property manager and me since (I only email maybe once in three weeks). I understand that having a baby is a big deal but usually does not excuse you from paying rent.

She had given me checks for the year to pay her rent with (in lieu of a cosigner) and I tried to cash the June one last week (because she told me she could pay and then didn't) and it bounced. Every one of those checks bounced, even before the corona virus. She moved in January 1 2020 and did end up paying up through March despite the bouncing of each month checks.


Does you have any advice or updated information? Oakland is extremely pro tenant, and I was told by a lawyer there is absolutely nothing I can do except try to get mortgage forbearance. The property managers are also throwing up their hands. I am still paying my mortgage because I wanted to refinance and was thinking I would not be able to if I didn't pay it. It was also confusing as it said I had to pay the entire balance after 3 months (I am aware this can be extended).

Is there any landlord protection for this kind of situation? Any programs that are paying rent for people like this? Curious if there is a solution I am not thinking of.
