Post: Business structure in NH to hold a 5 unit retail building?

Hi Derreck,

Congrats on jumping into the deep end!

I recently created an LLC that is owned by my revocable trust and transferred my rental property into the LLC. So, to answer your first question, it is allowed in NH. As far as the charging order protection, I'm not sure about that. I think you may need to consult with a lawyer.

I will say that the way my LLC was filed with the state, it didn't really give me the level of anonymity that I thought it would since I am still named as the the manager of the LLC which is public record.   I suppose if you can list the trust as the member or the manager of the LLC, and your name is not associated with it (except in the the operating agreement which is not public record) then you might be able to remain anonymous.  But I don't know if that is possible.  Again, I think it might be worth it to get some legal advice.

Good luck and let me know if you get any more info on this.  I'd be curious to know what you find out.

Thanks,

Lou

@Patrick Foley

Hope you had a great round of golf!

I plan on being there tomorrow.  I'll try to get there a little early as well.  See you there.

@Patrick Foley Welcome (from another Hollis resident).  I didn't realize there were so many Hollis residents here on BP.  I've been here 2 years.  Great community.   I kept my house in Nashua when I moved here and turned it into a rental property.  It's been going so good that I'd like to pick up some more rentals.

@Richard Lovering mentioned the meetup at Fody's on the 17th.  I attended  last month's.   There's a lot of very knowledgeable people and its a great networking event.  I highly recommend it.  I'm going to try to make this next one.

If you,  @Matthew Stanizzi, and Richard are getting together for a beer,  I'd love the opportunity to join you all.  Just let me know when and where.

Thanks,

Lou

Hi Nick,

Glad to see you're reaching out into the forum.  I've also been looking mostly in the southern NH area.  I haven''t expanded my search all that much into the Manchester area, but appears to me there are better deals up there compared to Nashua.  Although I worked in Manchester for 14 years, I don't really know the housing market or neighborhoods that well.

There's a meet-up coming on June 17th in Manchester:

That's a great way to meet people.   Maybe I'll see you there.

Hi Christopher, ,

Interesting predicament.  It would seem to me that if nobody can procure a written lease then there's no way they can hold you to anything, since there's no proof.  Otherwise they could claim just about anything.

I hope someone with knowledge of the laws can chime in with an answer to help you out.

Good Luck!

Hi @Michael Ketchen,

Sorry I missed the first meet-up.  Sounds like you had a great turnout.  I'm glad to hear you're having a second one.  I hope to make it to that one.

Hi @Michael Ketchen,

Looking forward to it. If I don't make it, I'll take you up on the coffee meeting.

Hi @Michael Ketchen

I will try to make it.  I have been wanting to get to a local meet-up for a while, but timing hasn't worked out.  If my schedule aligns I'll try to make it.

I have also used Sean Gallagher for several drywall projects in the Nashua area.   He is awesome to work with and does a great job!  I highly recommend him.
