Is it possible to 1031 from a out of state rental to my current home?   I have a duplex out of state I would like to sell.   I am wondering if I can take the proceeds and roll it into my current mortgage.   I owe 1/3 of the value of the house on the mortgage and that should be close to what I net from the sale of the rental property.   The premise being that I will rent 1/3 of my current house, either short term rental AIRBNB or roommate.

@thomas s.   Thanks for your reply.   Though it doesn't answer my question, and was arrogant.   I did give 24 hour notice before serving the 1st 3 day notice.  Possibly the name of my business?   Sounds like you have no idea what you are talking about bud.  Why post?

@Brandon Sturgill, I am pretty sure that if they still had their stuff in the place after those 30 days that I would then need to file an eviction.

Appreciate the responses.   My question seems to be missed though, with lots of suggestions of items already addressed in my post.  

Should I have my name and business name (as owner) on the three day notice, even if served by my mother-in-law?  Should she also be on the notice?   She will sign the affidavit stating she served the notice.   Hopefully she will not have to go to court.

Hi Mr Reid. 

It’s my understanding that the person who serves the notice would ideally join the lawyer in court.   If unable to go to court the person who served the notice would sign an affidavit that the lawyer would use in court.  I’m wondering how that all relates to who signs the 3 day notice, who serves the notice, and the owner and business owning the property.

Property is in Columbus Ohio.   I’m out of state.   Tenant hasn’t paid rent for December.   Tenant hasn’t been at the rental in December.   Tenant not responding to communications.   Tenant is on social media getting new tatoos and telling people how to live righteously.    Tenant is on a month-to-month lease that was the default of a previous 9 month lease.   

Tenant has some belongings of little or no value in the apartment.    Old beds, couch, beat up bing pong table.    More junk furniture in garage.   

On the 15th I had my mother-in-law, who lives 30 minutes away, serve a 3 day notice.    She handwrote it on a full sheet of paper and photographed it.   It’s on the coffee table right inside the door.   

Because the tenant hasn't had the power on in over 2 months, and the camera wasn't the best, the notice doesn't print perfect, but it's legible. It has all the necessary Ohio wording and has my name and the LLC name the property is in.

We also didn’t know the notice couldn’t include weekends and holidays.   So it had the date of notice, specified 3 days, and specified to move out by the 18th.   

Since the property is in LLC name I have to get a lawyer to handle the eviction.

Lawyer wasn’t impressed with 3 day notice.    Said it might work, but if not it’s a waste of time.   Recommends serving again.   

If my mother-in-law serves a new notice should it have her name on it?   We are hoping to file the eviction when the court re-opens Jan 2nd or 3rd.   It’s a bit tight with holidays and weekends, but I think we have enough time.   

Can the lawyer serve the notice?   This lawyer lives close by but didn’t mention that as a possibility.   

Anyone have a sample they have used in Franklin County?  I found some samples online but they are all a bit different.   

I think it’s unlikely tenant will show up for court, but I’d like to do everything right to make sure this goes on his record.   I’m happy to work with tenants through financial issues, but no communication I can’t handle.

I have a tenant who has been renting for 2 years.    Have had some issues, but nothing major.   The second lease was for 8 months and has expired in September.   My lease defaults to month to month.   I have been trying to get the tenant to sign a new lease to carry through the winter (Illinois), but no luck.    I did a walkthrough a few weeks ago and came to find out the tenant has not been living at the place for a few months.    This is concerning with winter coming (heating), and generally the place is in bad shape and full of mice.   The gas and electric were off.  

He told me on the 25th of November that he would let me know about a new lease by December 1st.   The 1st of the month came around and he said he had the heat on, but did not answer about renewing the lease.    On the 6th he said he will not be renewing.  I asked when he will be moving out, he said this weekend.   I clarified that he will have everything out by the 10th, and he said yes.    I informed him this doesn’t coincide with the lease 30 day notice month to month policy.   However Im ok with the moveout.    He has not paid any rent for December but says he will pay for the one week.    I have all this in text.   

My question is:  Since I have from him that he will have everything out by Monday (tomorrow) in writing- can I change the locks even if his stuff is still there?   

I’m very doubtful he will have moved everything, if anything.     I need to start repairing the place and get the heat on minimum.    This is the worst time of year to deal with this.   I made the mistake of being lenient with renewing the lease in the fall.   

Post: Drain leak cleanup in crawlspace

Hope this is the right forum.  I’m not necessarily looking to do it myself, but I also don’t just want to pay a company $6k and assume they know what they are doing.   

 I have a drain leak under the house.   It’s the main drain line, original cast iron, and totally corroded and leaking in multiple spots.   Unfortunately I suspect it has been going on for years, but I just bought the place and the inspector missed it.  

The house has a raised foundation and the crawlspace is pretty clean, but the ground is soft In a circle with at least a 12 foot diameter.   I am having the drain replaced, but concerned on proper cleanup and drying.    The house is in LA county, so we are getting warmer weather, but it’s also pretty humid still.   The house seems to have wicked the moisture, so I think a dry out is necessary - fans and dehumidifiers.    I have read suggestions to fog with some sort of antimicrobial.   Some say chlorine solution but I’ve read that urine can create gas with amonia.    Another solution I have read is to install a vapor barrier.   I can see how blocking toxins could be  good for air quality in the house.   It’s original wood floors so I think a good amount of air does come up into the house.   It seems though that a vapor barrier would have issues with maintenance down the road and whatever is deeper in the ground after a dry out would never resolve.  

I bought the house to try and house hack it, but living on top of this has proved quite stressful.   I’m almost one month into it and can’t imagine getting a roomate anytime soon.     Certainly their is a lot to discuss about the purchase and perhaps inspector, however my main concern  right now is fixing the problem.   Does anyone have any advice on the best approach to cleaning up this mess?   Or a place to find more info?  I feel it’s a serious health concern.

Thanks for the response.   You are suggesting I keep trying to collect rent for July but also notify them that their lease ends August 1st and they will need to move out then?
