Post: Targeting Probate Leads - Wills vs No Wills

Anyone knowledgeable with Probates? I'm currently researching these records in my county and have found that some of the deceased's real property was moved into a Living Trust. I have heard that this keeps the property from going through probate, but either way, is it still worth reaching out to the executor listed to see if they would be interested in selling, or would I be wasting my time and money?

Secondly, many of my county's records have these case types classified as "Letters of Testamentary." From my understanding, these cases are no different other than the deceased had a will. My question is that do I reached out to the named Executor just as I would in a "non-willed" probate case to see if they would be interested in selling the property, or is more research needed to see if the property was willed to another individual (not the executor). I know the executor has legal right to settle the estate, but unsure how this would work if all debts were settled, the house has not been sold, and the deceased's will stated that they wanted to leave their property to a different person (or multiple) other than the executor.

Has anyone had experience building a wood privacy fence in a flood zone AE area?

Back story - Recently had a to pull a permit for a garage conversion for a flip that I am currently working on. When the city came out to check on the garage, they noticed work had been done on the fence. Due to city regulations I did not have to pull a permit on the fence since less than 50% of the fence was being worked on. However, the city official still decided he wanted to further investigate the work. He determined that the backside of the property is in a flood plain and will more than likely need to remove one side of the wood privacy fence and replace with chain link.

The thing is that the house is not technically in a flood zone. It is near a flood zone AE area, and a piece of the back part of the fence does look to slightly touch the flood zone AE area on FEMA's map. It is far away enough though that neither my insurance nor the previous owner's insurance required flood insurance. In addition, I have sifted through the city's website and cannot find anything that said a wood privacy fence cannot be erected in a flood zone (giving him the benefit of the doubt here).

My question is if they come back and say that it must be taken down what should I do? Is there anything I could possibly do to prevent this? Obviously this would be a large blow to my rehab budget and profit overall.

@Caleb Godsey Hi Caleb! I’m from Austin as well and was in a similar situation as you a few months ago. I decided to go the hard money route for my first deal in Killeen and have had a great experience. I’m mainly interested in BRRR properties as well, but the deal I did made more sense as a fix and flip after looking at the numbers. Looking for recommendations on quality general contractors in the Austin, Killeen, and San Antonio, Texas area. Primarily looking to do rehabs pertaining to the BRRRR strategy so if anyone has had great experience in these markets using a general contractor I would love to hear about it!

I am a new investor living in the Austin, TX. Currently, I am looking at deals ranging from far North Austin to San Antonio and anything in between. My main strategy is BRRRR, but am open to educating myself in all areas of REI. I would love to connect with other investors to bounce ideas and strategies off of in hopes of furthering my REI knowledge from your experiences.

I am also open to partnering with someone on any upcoming deals and beyond. My background is heavy in property management as this has been my regular job for the past 10 years. I have experience managing properties in Austin, San Antonio, and other markets within Texas. My long term goal would be to partner up with someone who would want to continue doing deals together and build up a portfolio of rental properties.
