In another thread in a different forum here on BP, the original poster had a dilemma of being three years behind in rent/utility payments.

A lot of the responses were irked (to put it mildly) at his gall at wanting a *deal* from his landlord/roommate.

A simple glance at the OP's location Berkeley, CA indicates his mentality. Cuba and Berkeley, CA are the only two places where communism is still practiced .... and Cuba is crumbling.

OK, I relegated this to the political forum to protect the innocent ... ME!

Consider the obvious.

All those salespeople that you see (and that assault you) have to get paid by someone as do the people that make the presentations. All the freebies - free golf, hotel rooms, meals, massages/spa packages, etc - also have to be paid for.

Where do you think that money comes from?

I agree with what Bill stated.

Certainly read the agreement carefully.

But you have to ask yourself .. and your buyer partner why the parts of the NCND are necessary.

Are you going to circumvent him to get into his wallet? That is ridiculous on its face but it may indicate that your buyer is not the money guy. If he is the money guy, you can't circumvent him.

What information does this partner NOT want you to disclose? Certainly, the end buyer will be disclosed to the seller at some point.

Does the non-disclosure prevent you from accomplishing your duties?

Have a long talk with the buyer.

I certainly don't have all of the answers, but something has to be done to get people employed. I saw a study that someone posted that claims 55% (!!!) of people have been laid off, had their hours cut, or are marginally attached to the workforce. That is a STAGGERING statistic. Is there any wonder people are nervous and unwilling to spend money? U6 unemployment is at 22% and Europe's debt crisis is very worrisome.

I certainly agree with the current view of using taxes to *ATTACK*. It does not make sense.

Specific example - the tax on Medical Device manufacturers included in the Health Care Reform bill.

How does imposing a tax on a manufacturer (or anywhere along the supply chain increase the supply of anything at a lower price?

As for the unemployment, this comment is based on my own small observations, but I know a lot of people that are *unemployed* and collecting unemployment benefits but are also working under the table at some job, albeit for less than 40 hours per week. Too many people learn how to game the system which leads to more burden on the rest.

Mike,

I think MICROSOFT stock will hit $50 per share in a couple months. It trades at around $25 today so if you lend $2,500 today I can buy 100 shares and pay you back when it hits $50 per share. That is only 50% of ARV.

I'm sure your answer is no because you are taking all the risk in the scenario.

Lenders are the same way today. They want you to have skin in the game.

If you don't have your own money (around 20 to 30% of purchase price) then look to birddog for an investor until you build up your own money to use for investing.

Bill, my previous point is just meant to point of the obvious.

The suggestions here are to find a third party (possibly a lawyer) to buy the property (possibly via short sale) and then maybe even a fourth party to buy the property so that the current owner (who may or may not have title) can then buy it or lease it and not have to move.

My much simpler solution is just to move. Wait until the current owner's financial position has improved and then buy a house.

No one here provided an answer as an attorney so to suggest ways to skirt the issue of having the current owner stay in the house and not benefit is splitting hairs ... frogs hairs at that.

The easier solution is just to move and hire an attorney to hound the deadbeat dad.

Applying Occam's Razor ... buy another house, have your daughter/gkids move into one of your currently owned properties or rent an apartment or other home.
