Hello all,

We are in Illinois, but I'm assuming this may be good for myself and others down the road to hear responses to.

Have a qualified prospective tenant who was to sign a lease a week from now, and had paid a deposit to hold the unit weeks before that.

A deposit held for a unit with verbal and written transaction record enough to hold firm to that commitment? Our is there legality I'm unaware of, setting the tone why we would must give that back?

We have turned down others for this unit since taking the deposit, and the owner may not be willing, unless legally required.

Does anyone have any insight to a situation like this?

@Lynn M. That was partially my concern as well, but I'm assuming if I act on what I think I know about the process.

We were instructed just to move forward with the notice, again. Should've listened the first time! I struggled in this case mostly because I read the article about her death to confirm the event, and was a traffic story full of grief.

Thanks to everyone who commented. There's a part of me that wants to help, and I can see how that's a real temptation towards shooting ourselves in the foot.

I think I heard what the more logical parts of what my thoughts normally follow from most the advise given... Including the lawyer. Thank you for that!

I've recently gone from having influence over a few rentals to over a hundred, one challenge for me is identifying and acting quickly as the new situations come my way. Appreciate all the great insight!

Tenant was working respectfully towards repaying $4800 rent bill. She even let us do a inspection, and was clean and took care of her place with pride. However we did find out there was an adult daughter living with her not on the lease.

The plan going forward: was scheduled to soon come in to pay in full, or work agree to a repayment plan.

First week of this month daughter calls sharing she has no money to pay, and Mom had passed in a car wreck.

Lawyer instructs to provide a 5 day pay or quit, to record the outstanding rent. We first want to respect the daughter an offer lease in her name to help with all the transition she's in, while notifying her of the eviction process on her mother.

She's now demanding all documentation of her mother's file to dispute the rent charges due, and to provide to her lawyer.

Any advice to this? My inclination is we shouldn't share any documentation further, now that it's clear it's going this direction.
