Thank you Dennis. Very helpful! I will get him notice on the 10th with the 10 day notice to quit lease for non payment

John Thedford IS WAS FOR ABOUT $450 AND LEGAL FEES. THE TENANT NEVER EVEN TRY TO CONTACT BEFORE FILING THE COMPLAINT. 

I see. If I dont receive payment by the Monday I will give him notice to end lease.  In the lease agreement he waived his right and agreed I can end the lease agreement. 

Ok. So should I place the notice on his door on the 10th and file the papers through the court for eviction?

Carl I dont not have a move in checklist unfortunately but my lease did day if there were any damage to property that tentant should notify me and they never did. Do you like I could get them to pay my court fees? My lease did states that they must cover any legal fees..

Hey Everybody, 

When I purchased my duplex I inherited tenants. They were giving notice and the resign my month to month lease agreement. They moved out a day later then the exit date so I charged them a fee which they were notified of.  After sending the security deposit with deductions for: holes in walls for TV mont, paint cost for kid writing on the wall, damage door knobs and damage to the flat kitchen drawer the tenant wants his full security deposit back stating because he was living there before I brought property and because the damage were already there. I have pictures and receipts.

Hey Everyone,

I received a text from my tenant on the 4th of the month stated he would be late on rent and would pay on the 10th. He is aware of the 10% late fee. My question is if I dont receive full payment by the 10th can I file for eviction for non payment, and lease agreement? He smokes and has the hallway smelling like sweat. His home so much I dont believe his working anymore. The lease only started in July. I dont have patience for non payment when you just moved in..

yes.  Introduce yourself as their new landlord.  In you letter be friendly, but firm.  Let them know you are readily there to address their needs in connection to the property (unless it will be managed by another company and in that case refer to them).  Inform them where to contact in various situations.  Inform them where to send subsequent rent payments.  If you desire to change their rental terms let them know, and as rule of thumb as each state or county,s regs may be different, give them 90 days from the purchase of the properrty until your nee rental agreement comes into effect.  Send a copy of the proposed rental agreement and request signature or rebuttal before 60 days.  If they do not sign that leaves you with 30 days to decide how to proceed in event they do not sign. If at any time they becime 15 or more days late, begin eviction process.   I am a softee, so others may suggest stricter guidelines.

Gods will my closing dates is February 28th. I was thinking mailing the letter of notice with next date delivery with a signature required.

Definitely request to rescreen them to have them sign a new lease. Since they are month to month I would get them on your lease as soon as you can.

Also, you'll want to screen before putting them on your lease because you don't know them. Living in the unit next to them makes that even more important.
