Post: A Letter from Consumer Services for Already Evicted Tenant

Hey BP Fam,

My tenant was evicted over a month ago and the locks were changed but I received a letter from the county Cable and Consumer Services saying he wants the eviction investigated.

Quick backstory:

My tenant was evicted for being a holdover tenant and not due to payment or anything. The eviction process started May 2020 and after multiple continuances and an appeal to the Circuit Court from the General District Court, which he ultimately lost, the sheriff finally did the eviction last month. My tenant has since filed a frivolous complaint mentioned above but he does NOT even mention anywhere in his complaint that we ever went to court. 🙄🙄🙄

My question:

Does a County Cable and Consumer Services even have any authority and should I even bother responding? From what I read, their goal is to mediate/negotiate a resolution amongst parties. Why would I mediate/negotiate a closed case?

Any input is appreciated.

That is such BS! I hope your friend can claim the same back, duress and medical conditions as a result of all the stress placed upon her for not leaving the premises. I'm no lawyer but I don't believe in actual court, you can contest a non-renewal letter unless the time wasn't served enough in advance or it was improperly served but regardless of any BS duress or medical condition, that's all irrelevant. Please continue to keep me/us posted how your friend's situation played out and I hope she wins by a landslide! Does your friend have a court date at the absolute least? Mine is in the first week of August (after four postponements) but Rona cases as you know are up in Virginia 😏

@Mindy Jensen I believe for Venmo or even PayPal, you can just block their username or contact info but for Zelle, which is my preferred method, I don't see any block option but you're right, I can ask them if it's possible.

Does anyone know if there's a way to refuse/decline payment from an electronic source?

Reason I'm asking is in the case of a holdover tenant or something of that nature.

@Shiloh Lundahl Ironically, my disgusting tenant never contacts me and I wish he hoarded water, lol, instead of garbage, he don't even use the washing machine or shower to my knowledge but funny you mentioned a garage, my disgusting tenant has been renting a garage spot from me for over 10 months but..he doesn't have a car and there's NOTHING but an empty spot sitting there! I wish he hoarded his garbage in the garage cuz I believe that's somewhat common area (it's a 2-car garage) and the other tenants could just presume it's garbage, which it is, and just throw it out.

Let me know how your tenant acts when you ask him to leave, hope you have no issues and he won't try to delay and use the stay-at-home order as his defense like mine.

@Shiloh Lundahl Thanks for the response and suggestions! lol, I just need to find that someone willing to speak up. My disgusting's tenants roommates currently are arguebly the nicest/least confrontational/most spineless people I have ever met, they might complain to me about him here and there but never followup and/or say "just letting you know but don't worry about it" like they will tell me he smells and hasn't showered or washed his clothes in days to weeks but can't tell him to do so directly?

It's my belief my disgusting tenant lives in solitary confinement by choice in his room 24-7 with headphones on and never leaves except for food. Further, he has no bed but can't see the floor/carpet in his room either so how he sleeps is beyond me.

What kind of things have you heard that your boundaryless tenant does and have you ever spoken to him about the issues or the roommates have been able to resolve it on their own?

@Joshua Klein I offered him a full month free and he said no, he'd be homeless, but he gets $4K/month in pensions and SS...

Hey BP Family,

This post is connected to the same disgusting tenant I mentioned in my previous post: Tenant Threatening Police For Showing - COVID-19 / Coronavirus.

The disgusting tenant mentioned, who always pays on time if not early, appears to love collecting garbage in his room and has violated the lease agreement as a result. However, his lease also expires April 30, 2020 or the end of this month and he was notified in December 2019 that his lease would not be renewed. On the other hand, Virginia courts have suspended accepting any new eviction cases until April 26, 2020 as well.

I plan on using a lawyer to see through the whole eviction process but we all know they are a business themselves so my question is, should I even bother starting to attempt to evict him with the lawyer on the basis for violating the lease agreement for his waste/failure to main the premises clause or should I just wait until May 1, 2020 and hope courts are open then and serve him for being a holdover tenant or try evicting him for both?

Does anyone think tenants may actually have a very strong and accepted defense using their state's stay at home order for not relocating anywhere?
