my ex is now in jail for violating the stay away order. He also has criminal chargers so he's looking at some good time in jail. I'm thinking about evicting the tenants if I can and moving onto the property so he can't move anyone in. He cannot buy me out because he has no money and visa versa. I am not looking to sell this property at all. I'm in the process of putting up a cell tower which I signed a lease to AT&T with recently. I will be taking him to civil court to get him off the deed as soon as he gets out of jail. I suppose what I should do is go out there and speak with the tenants and see what agreement they made with him? Thanks everyone for the advise.

I'm not receiving any of the rent he is getting from them. He has had them sign a lease from my understanding. So yes they have rights. I don't understand how he can do this because I should have the right to have a say who is allowed there because it is 50/50. I know after 3 months they have squatters rights. I will contact a lawyer as soon as I can. Thanks

So Im going to try and keep this question as simple as possible as my situation has become quite complicated. Long story short I am in a battle to get back my DIY investment property in California. While working on my property my boyfriend (who was helping me out at the time and is now my ex) coerced and threatened me under duress to put him on the deed. I am facing taking him to civil court to get my property back as there was domestic violence involved as well during the time of this threat. While I was away at a Women's Shelter he took over the property, leased out the land and moved in a bunch of homeless people. I don't know any of their names, I was able to get a Restraining Orderagainst my ex and a Stay Away Order from the property. Alas, the homeless people are still on the property (im assuming so they can be his watch dogs) The police have done minimal help, they were able to go out there and arrest one man who had a warrant and got his name but he was unable to get the names of the other people. Can I serve them a 3 day Notice to Quit without knowing their names. Because my ex is still on the deed and he moved them in, is that legal? On the deed it states My Name AND His Name. Not OR. Should I wait until I get him off the deed or try and fight to get them evicted now?

I was proposed by AT&T to put a cell tower on my property in California Valley, CA. Its a very rural area and barely any cell phone service out there. It would be placed in the corner away from the house on the 2.5 acre lot. They asked 500/mo with a 7% annual increase. I came back and asked them for 800 a month and they accepted no questions asked. Now Im thinking the lot is worth way more and I negotiated way too low? Is it too late to ask them for more? How do I find out if this is a hot spot or what its worth without having to pay multiple real estate attorneys?
