We have a tenant that is accepting the letter we sent outlining the extensive damages she did. We did it legally and sent an itemized invoice with receipts and she is willing to pay us back over a period of years. We want to write up a promissory note relating to this. Does anyone have anything they have used as a template for this type of situation that acknowledges the debt is due to damages and accepts responsibility and is legal in Ohio?

I disagree because I was getting complaints from the neighbors they they were hearing the fights every night and loud thumping and more holes being put into the walls. Removing her saved me from losing my tenant next door and it surely saved me from having to completely redrywall the place. And she was causing daily issues with her complaining and other people’s complaints.

I agree. Thanks. Ironically she spent the whole lease assuring me she made plenty of money to pay her rent and sending me her poi a couple of times to make sure I would extend the lease. She always paid her rent but the damages were discovered and we had to get them out for that.

Hi all, 

I'm looking for the best way to handle the following. We had a tenant who claimed to have 4 kids, and then ended up moving in 2 more kids and the father. The fighting ensued, and they did over $10,000 worth of damage. (yes, I've already done a look at how to tighten up our tenant recruitment). I kept careful receipts, the repairs are all done. A nice new tenant is in place. The old tenant has received her damages letter subtracting the security deposit. This was all done legally and with consultation of a lawyer. I'm not looking for advice or comments on any of that. Thanks.

She received her letter yesterday and contacted me with the following. "Hello there. I don’t have 10k to pay you. I’m a single mother of 6 children and I just was discharged from the hospital due to COVID and I currently have 2 kids with COVID. I can pay you $100 a month."


What would you do in response to that. On the one hand she seems to be saying it's a lost cause, but then on the other hand she is not fighting me about the actual notice and by saying she can pay $100/month she is accepting her responsibility for this.  

What would you respond with? If we accept this $100 month we are looking at dealing with her for over 100 months and basically extending her a 0% loan for years and years.

@Steve Morris I get it. It’s an area that people don’t want to mess around and screw up on right? But I would suggest this whole business could fall into that category that we might get conflicting advice, some not good. If I post on the forum, it’s with the recognition that some of the advice may be completely wrong and even illegal, but I appreciate your caution in this area. I just have a higher risk tolerance for asking advice in this area than you.
