buying a house in LA, standard sale through escrow, the agent represents both the seller and me, the buyer. At this stage my lender who is ready to fund and I already wired all 20% down-payment. The last thing was walk-thru. and record tomorrow... Suddenly get a message from escrow ... we are not closing tomorrow, we are waiting for the updated payoff demand from the sellers bank...!Allegedly the seller discovered JUST NOW (we were in 45 days escrow) they have a lien on the property. I am thinking... they knew it before but played me as the HUD didn't contain any seller's payment break down and the final title wasn't forwarded to me neither. Any feedback/advise from the experts? :) Also since i am in the dark and didn't get the NOD or payoff info

@Wayne Brooks OMG! Now I understand exactly what is happening. You just pointed it out. They did forwarded the HUD to me , but when I asked why don't I see the seller's part on it, but only mine - they just ignored my questions.I've bought the property before and the HUD was clearly stating what the buyer pays and what the seller. Do you think it is not legitimate and they are not playing I by the rules? Isn't the escrow officer s u p p o s e d to forward this info to me?...

@Rick H. thanks for translating Rick's language...:) may i ask what RM and UPB stands for?..:) Escrow is keeping me in the dark as they are all 'friends'...may be i am a bit over suspicious (well... i am russian...:) but is there a question i can ask that they can not refuse to answer? (by the law?) for example...what is the lien amount and what wasn't paid by the seller and since when? appreciate your feedback...:)

@Rick H. Hi Rick, it took me a little time to process.The escrow was scheduled to close tomorrow ,but now the escrow officer emailed:' .....I just wanted to let you know that we are not closing this file tomorrow. We are waiting for the updated payoff demand from the sellers bank. Once we receive this we will request your lender to fund the file and then we will record the day after...' she didn't reply for when she estimates it will happen. I am curious if in this point i should take a lawyer? Is this escrow fault?sellers? I already wired all the money and signed notary papers with the escrow officer (is that NOD? didn't find what means the abbreviation) my lender was ready on the 30days but the seller insisted 45 days.They just discover this few days before closing? do I have a case here or shall i just let it run it's course?

@Rick H. Rick, i have made an offer on this property as a standard sale. So the Real estate agent represents the owner and me but when it comes to ask her questions she is very evasive. I asked to show me last utility payments and she said oh...the client does't know where they are. The mother was making the payments and she is the one who passed away and had the mortgage.The seller is Successor of the trustee (the daughter)...At the same time the escrow officer sent me the prelim documents and the title was clear...what documents should i look at to make sure i am protected?

@Wayne Brooks you are correct. The mother, the borrower passed away and two daughters inherited it. The property is in Trust name. The prelim title was clean and so the final title which I signed through escrow didn't show any lien, The lender added a title insurance to my closing costs. Does it saves me from any future possible lien (if any?)

@Steve Vaughan thank you for the cheers! I am buying it with the though to rent in future...so the worst thing would be instead of profit to start dealing with the creditors...LOL

@Charlie Fitzgerald thank you thank you! I will tell my lender to do call the lien holder and get me the answer! Thank you for the advise!

Need an advise!!!!Buying a house in LA (ESCROW does the title here, we don't use lawyers in LA ). Escrow close on 10.15, all the docs are signed and the financing approved....Oppps...The real estate agent calls me today( she represents both seller and me, the buyer) and beats around the bush about the letter that  the seller received just now about...foreclosure?...or short sale?... the agent is really only loyal to the seller and she is very evasive and full of bs ....and she keeps repeating the mantra:..just never do what the seller did - a huge mistake, -  having a reverse mortgage... All this  makes me even more nervous. I asked to forward me the letter - she refused. What shall i do? The agent and the escrow officer are kinda together ..My lender is also eager to close the deal. What shall i do at this point to protect myself? Do I need to be worried? Do i need to request some additional documents? help....
