Hello BP group, I would like to see if anyone have an answer to this question. If a seller sold a home to buyer, and the buyer used a closing attorney and had purchased a title insurance prior to the transaction close. The property was then closed with a warranty deed issued by the seller, but the mortgage lien originally on the property was never cleared, and the original lien holder end up forclosing the property under the sellers name? who do you think is responsible and why?

1) the buyer ?

2) the seller?

3) title company?

4) closing attorney 

5) the mortgage company??

@Tom Gimer, I understand that, I think the closing attorney did something wrong in this case. Like I said, I have no issue of paying for the premium and when I closed the property, the title has no issues, I think the title issue came after the closing was done. If that’s the case, if the title insurance offer me a commitment to provide a policy, should I have the right to buy it? If there’s an issue with the title, I know my attorney won’t allow it to be closed with a warranty deed. (The only thing I see in the closing statement is the title company agree to issue a title policy with the exception of what a survey may review). Well Tom, thanks for your help I appreciated, I had already contacted the closing attorney and the title insurance in which they both stated that Tuesday they will have an answer for me. If it’s not an answer I want to hear then attorney is my next route. It’s just so unnecessary because I didn’t do anything wrong. ( I didn’t reject the title policy, I even verified prior to closing,) anyhow, things happen for us so we can grow right!

@Tom Gimer, also, I don’t understand how they would issue and closed my deal with a warranty deed and have a title commitment without giving me the title policy...

@Tom Gimer, I didn’t sign any paperwork declining any coverage, additionally, I have no issue of paying for the title premium, for the binder is it required for them to issue me the policy ?

@Tom Gimer, looking at the statement, I had the title search, title binder I don’t see title insurances premium.

I have some issue with a property that I hope one of you guys can answer. So long story short, I closed a property in dec, 18, 2018 with a closing attorney, and with the closing statement, I have a title insurance binder. I got my warranty deed under my name. I been trying to get my title insurance policy but I am now being refused by the title company to offer me the policy that I have a binder with. (This property is in Alabama), is there anything I can do at this time?
