The contract has been in use for decades and, by necessity, is in a constant state of revision. A proposed offer may be crafted from a library of over 100 forms — not pages, forms — and may include: — more than a dozen transaction-specific contingencies.— timeframes for performance or inspections.— related qualifications as to test results.— county-specific implications. This event is not an attempt to replace the expertise of an agent. But Bob will help you gain a critical understanding of language that can make a difference of thousands of dollars when carefully crafted in the contract. Topics will include:
- Whether a licensed agent must use an MAR contract.
- What “using” the contract means: filling in the blanks vs. writing a contract — that is, what are the capability and liability of the agent and brokerage?
- Can boilerplate language be modified?
- What happens when material terms are missing?
- Why you don’t use a postal address as a property description.
- Why is the brokerage part of the contract?
- When can a buyer get out of a contract unilaterally? When can a seller do so?
- Is the MAR contract a “buyer’s contract” or a “seller’s contract”?
- What prevails when language is conflicting?
- When “as-is” means precisely that, and when it only means “kinda.”
