Hi all. I have a seller of a property in probate. Property is underwater; worth about 35K but owes 100k on it. Property was owned by seller's mom who passed a few months ago. Seller wants to do short sale but told me he is the beneficiary of an insurance policy that is probably enough to pay off the mortgage balance. However, he does not wish to use the funds to do so. Since the bank will not OK the short sale once they learn of his financials, is there a way I can still profit from this deal or is it just dead in the water? Seller doesnt want the property but is unwilling to use any funds he inherited to pay balance.

Thanks for both replies. I'll disclose the matter to my broker asap.

Also, neither of you have had problems when it came to selling the contract or interest in a property to another party at closing time? the selling party didnt have an issue with you as a realtor selling the deal to another party?

I'm probably overthinking this but just want to make sure.

Are there any wholesalers out there who not only have a brokers license but also work for a broker? Reason I ask is because that is where I am. I just started working for a broker but I got the license primarily to get access to MLS. I'm want to focus on wholesaling and have come across a possible deal. Must I disclose my intent to sell a contract in a deal to my broker? Can any of you seasoned realtor/wholesalers answer that question for me. Much appreciated!
