If you have the property under contract it's yours to wholesale or actually purchase. If seller backs out you can go through the motions of filing suit. Did you give owner an EMD?

Hey BP!

Working on closing this deal, but ran into a snag. Property owner came into possession via Quiclaim Deed and all that paperwork is fine. The issue is when the parents originally bought property in 1999 from the estate the title company was unable to locate those probate proceedings. Current property owner has not been successful in locating heirs, and executer of the estate is also deceased.

Has this ever happened to you? Title company of course says they cannot move forward until additional information is presented to assist them in locating the probate proceedings.

Hey Linda, You can flip your contract as long as by your name or business name it says: and/or assigns on the contract. Does the price the cash buyer agreed to include your assignment fee? Send me a pm and I'll provide you with a sample contract. Also look in BP files. There are tons there as well
