Lease states, third party checks will not be accepted a d tenant acknowledged this by email before he signed the lease that all future payments would be in his name.
Thank you all. At this point I need him out so I can sell. In my lease it states no third party payments this can also muddy the waters when it comes to who is responsible. His parents had a chance to sign a Co sign agreement and declined. At this point, I don't care about the last month or late fee. It would be nice to get it paid but I can write it off. Need him out to sell, will be returning the money and starting the process. There's also other issues if I sell and he's still in there. Thank you all for the advice but I don't think taking a compassionant approach is going to solve this one. If he approaches me I will try and help but he needs to take the steps to help himself.
Jay, I appreciate the advice but I don't think you read the part where I am relocating so I want him out/selling. I mentioned the tenant decided to pay (without the late fee) but I am moving and he needs to be out anyway. If he decides to drag out the process I've wasted time. Might as well try and continue the process to get him out, yes?
Marcia, Thank you and of course others for the excellent worded advice. My property resides in CT. He is not a student but a tenant who had a job and had a major downward trend and seemed to give up. Instead of finding a job, the tenant cashed his grandmother's bonds and goes out to casinos and strip clubs every weekend, he verbally told me this. Also the tenant started working for cash and I believe he may have been committing SNAP fraud but I have no proof. My intention is to get the tenant out as soon as possible. The tenant sent an email on the 11th stating he would leave July 1st but I can't trust him. I would love to end this rental on good terms but if I stop the process I'll be behind. I am also relocating and moving due to a job next month. My lawyer advised not to tell him this and not speak with him to avoid being taken advantage of. I wish everyone was a decent person and told the truth but unfortunately that's not the case. The tenant has not approached me since receiving the NTQ. If he approaches me I will try and help the best I can. On the tenants part it's ridiculous to mail a check to the same address you live at. Also forcing your father to pay it? Happy father's day I guess. So my main objective is to get him out. He has no job, he is maxing credit cards, and committing fraud I believe. So my main question looks like has been answered. He still owes rent if he only paid 1000. I am guessing this might not hold up very well in court if I am evicting over 50. Comments?
Ray, All great points. I am taking the advice too seriously. I've reviewed the tenant and lord information. I am just being too careful. Since this is his last month here, hopefully. I'll just take it out of his deposit. I think this might be a better move. Just trying to avoid someone destroying my house during their last month here as he rents a room. Thanks.

Thank you. I don't know either but she mentioned the tenant could make claims of harassment or other things. I think that's where my lawyer was coming from. I have not cashed the check yet, so I will make that call.

I appreciate your feedback. How about the other areas? Should I accept it being from his parents? That may muddy the waters. Thank you for your help.

Good afternoon everyone,

The Tenant in my home decided to have his father mail me the check for the last months rent. I mentioned to him that after his parents paid the first months rent and security deposit I would only accept money from him. I have a NTQ which I had a marshal deliver to his door on 6/12.

Additionally, his father did not include the late fee in the check dated 6/12 which rent was due by the 10th.  The check just arrived today 6/15

My question is, should I email my tenant advising that I received the rent from his father and per our agreement at the start of the lease that he needs to write me the check himself and include the $50 late fee, *5% late fee? OR just deposit it and ignore the late fee? (my lawyer advised a no contact)

ALSO if he does not include the late fee, do I still have grounds for eviction as I do not want to accept partial payment?

Finally since he paid/trying to pay can I continue with the eviction process?

I will hopefully be in touch with my lawyer soon but wanted some advise.

@Nathan Gesner Thank you. I was mostly curious since I have a preferred method of contact as well which is email and phone. I will follow police procedure if this continues though.

Another question I have is, if he doesn't pay the rent or if he does and he doesn't leave within the 3 day NTQ. Can I still proceed with the eviction process and get him out?

First I want to say I have a tenant that's just been served a NTQ for nonpayment of rent that lives in my home. I have an attorney and she advised me no contact with him. The tenant decided to play the rent is in the mail game. Additionally, I believe he will be playing the parking in front of garage game. In the lease it's clear this is a violation and cars will be towed.

I call my cities police department and they advised I needed to give him 24 hr notice by certified mail to move his car. Is this correct?  Any information would be great, the process is rolling along but since he lives in a room I don't want to slip up.

Everyone, thank you for the amazing feedback. I consulted a lawyer and they said don't remind him or mention the rent is due. This would enable to file a notice to quit the 11th for nonpayment and at the same time because expiration of lease for July 1st. Also, the lawyer mentioned even if he pays his rent we could still get the process started and notice to quit the 11th for July 1st. Does this sound Iike good advice? Additionly, the tenant was bragging in front of multiple people/my friends about his welfare fraud during poker. Think I have ground if someone is willing to come forward?
