SO i have an REO property under contract and apparently the seller's agent sent us some forms that we're required to fill out as a part of "standard bank procedure." My Realtor said "sorry I don't know what they are" and got me to sign them anyway. I told him not to submit them until I get the reviewed by my broker and my lawyer. He said there's no need to because "banks use these forms all the time to protect their ***" - I'm still having a lawyer look at it though.

The section I'm most concerned about states

2. This contract is subject to acquisition of the Property by Seller

3. This contract is subject to approval and acceptance by Seller's mortgage insurance company and beneficiary, if any.

4. Final acceptance of the contract of sale is subject to Seller's committee approval.

Does this sound like short sale contingencies? The property is vacant and is listed as REO, but these subject to's got me worried.

Any suggestions?

I have a property under contract and I'm in the 2nd day of our 2 day inspection. I had the property inspected yesterday and the property was solid structurally, plumbing, and electric wise, but it did have a bunch of minor problems here and there:
- Guard rail on stairs needs reinforcement
- 3 faucets need replacing
- Water line not hooked up to one toilet
- Washer not hooked up
- Couldn't get Furnace to work due to Thermostat not functioning correctly
- Dead mouse in a trap in crawl space
- upstairs bedroom door needs re-adjustment - doesn't close shut

Would this prevent the property from passing an FHA inspection? The bank said they won't fix anything...

My broker is saying i can receive up to $11k in gift money in state of WA without getting taxed on it - is it true?

I think this guy is right up my alley:

I agree with you that “email offers†if they are not on the standard forms are worth very little. I would not consider anything else than a written offer to be a serious offer. All listing agents will tell you just to put it in writing and then it can be accepted or negotiations can start.

If you are making low ball offers you need the benefit of an actual written offer in front of the seller’s eyes to make them consider it, and to have them react. It also makes it mandatory for the listing agent to present it regardless of what he thinks about it.
