How does everyone do the renewal term in their lease? I changed mine because of auto renewal, to many times tenant would blow me off before the lease ends on the renewal term so I cant change anything since they wont sign a new lease and it auto renews.

This is what I currently have in my new lease, can anyone tell me if this is good or it bad. Any downside they if they dont sign a new lease they are living their without a expired lease?

7. RENEWAL TERM

This lease will NEVER automatically renew.Once the starting and ending dates are expired this lease will be void.

a. If TENANTS are moving they must give LANDLORD 30 day’s written notice before the end of the lease.

b. If LANDLORD wants the premises back LANDLORD must give 30 day’s written notice before the end of the lease.

c. if TENANT gives LANDLORD 30 days written notice before the end of thelease or LANDLORD gives TENANT 30 days written notice, LANDLORD has the right to put a “for rent sign” in the window or in the yard and show the property to potential future tenant’s inside and out. LANDLORD must notify current TENANT'S before future showings.

It sounds like you're in a decent area so your options for non-section 8 tenants may be plentiful.

Five kids is a lot but it could mean reliable, reasonably stress free (steady) checks for a good while. I can't imagine a Mom with five kids would want to move often.

The city I am in never really deals with section 8 to my knowledge because its very good and good quality of life. Yes if I only get $850 a month I still will make money, "assuming they don't destroy stuff which Im sure they will" school district are best in the state and neighborhood is very very good.

She does work and make $1800 a month but from what the HUD representative told me is that shes on a special program "like section 8" to improve her lifestyle. Get the kids in better school and get out of the ghetto. HUD also said if she does not take care of the property they will pull the voucher. I don't know what to think. I don't think the neighbors will like if I let them in, not to sound racist because im not.

Current tenant now had 3 months up front and good references and they destroyed alot of stuff which really gets me mad.

Long story short I never dealt with section 8.

She is a single mom with 5 kids, yes 5 kids. Right away I can see the kids damaging everything. Rent is $1050 a month and section 8 will pay for $800+ each month. She does have a job and from what this hud person I have been dealing with who called about the property is she wants to get the kids in a much better school district and will be moving alot closer to her job... The property right now is in decent shape. 3 bed 1500sqft and shes very excited and hopes it works out..

Would you accept or decline them and is there anything else I should know?

how can they hold you responsible though, you did not commit the crime? (not trying to disagree wihth you)

If you have a tenant move in and you know they were convicted of a crime can you be held responsible?

Do you change locks or have them rekeyed every time a tenant moves out?

Thanks everyone for your input.

I did give them 40 days notice of rent increase, first they said they will be moving then, 2 weeks later they said they have thought it over and would like to renew the lease. I sent them a letter to sign and they never did. Then I went to sign the lease with them about 6 days before renewal and they keep blowing me off. First of the month came so the lease, auto renewed, I cant raise the rent now but they are still required to pay. They keep blowing me off and on 6/8 they said they are now moving and use last months rent for this month which they never paid. I went to her work and talked to him at the house and both gave different stories. One said they lost there job, other one said im not a good landlord and they fixed alot of things and put alot of money into the house which I don't believe since nothing was really brought to my attention.

I guess I just need to use there last month rent for this month and make sure they move at the end of the month so im not out any money.

Any advice is appreacited.

It does say in my lease that is automatically renews for 1 year if tenant does not give landlord 30 days notice, so the lease renewed and 8 days into the " renewed lease" they want to move. They did cause some damage so far to the unit so far. I don't want to really get them mad and start trashing it more since they really have no assets I can go after. I do have last month and security.

Should I go over again and knock on the door and if they don't seems to cooperate and pay the rent give them a notice to quit.

I really should find a good attorney also since I don't have one, im still learning and new to investing only doing it 3 years and really have not had any problems.

Here goes

In May they said there moving. 2 weeks later they said they will renew the lease and I said ok and will do the lease on 6/1/14.

Lease ended on 6/1/14 but says It will automatically renew for 1 year without giving 30 day written notice.

I told my tenant rent was going up and few minor things changed in the lease and they keep blowing me off for 1 week and making excuse not to sign the new lease so I went over the property to have them sign the lease since its 5 days after the renewal. Well they said they might be moving now and still did not pay rent, (3 days late so far). They also said they need to put alot of money in the house and its just an excuse I believe since nothing was brought to my attention and they said there not happy and will get back to me in 1 day to figure out what they are doing, meanwhile they did not pay the rent.

What would you do in this situation?
