I thought I would give this thread an update on my post-Evermess experience.  So May was my last month of using them and I'm still getting emails alerting me that owner's statements are available! Lol

Big surprise that something somewhere feel through the cracks that they no longer manage my properties but I assume some virtual employee/assistant never removed me from their system.  Folks, this is what happens when someone tries to run a business based upon systems and processes without an actual intelligent human to verify what's going on....  FYI my boutique property management replacement has been awesome, I'm in contact with someone in charge who has actually walked my property.  It's just a day and night difference!

Just an update to those following the thread.  I *finally* received May rents earlier this month however my new property manager still has not received the security deposits...  Also I asked why they keep all the late fees and was told to look at the property management agreement.  I said it states Evermess can collect the fees but it doesn't say they can keep 100% of it.  

You think I should file a complaint with the Real Estate Commission to have them investigated so it will be clearly disclosed for future landlords??

Ask them for what?  I still haven't received my May rents from them, I assume someone from accounting will reach out to me, that's when I'll bring up the issue of the late rent fees.

I did a Control F and searched for the word "schedule", nothing came up...  But here's their price list, no mention that they can withhold 100% of the late fees...

The language you posted is from the wrong section of the contract. You want to look under the fee area to see the Late Fee split.

I probably would have fell for it if they didn't inherit me and my tenants after they acquired my previous management company.  I'm just trying to warn future landlords to stay away from them.  

This is no other section of the contract with fee splits, they are using their own contracts instead of the state's association of Realtors contract...

So another update on my ever worsening off-boarding experience with Ever-mess, my new property manager went through one of the tenant ledgers (not made available to owners) and noticed they've been collecting all of the 10% late fees!  First of all, 10% is a bit excessive and it was never disclosed to me that they are keeping all of the late fees as opposed to just 8% of it.  I went through the management agreement and found this:

Agent shall collect revenue from tenants and prospective tenants for
items such as, but not limited to: application fees, notice posted fees, late fees, lease renewal
fees, pet fees, document preparation fees, administration fees, and maintenance services.

It never said they collect a portion but it also doesn't say they collect all of it either.  What are everyone else's experience?  

The truth of Ever-mess' business model is coming out, have the best SEO and slickest marketing to lure unexperienced landlords with low monthly and tenant placement fees then over charge for maintenance whether it actually gets done or not then nickle and dime tenants with junk fees.  Let's see how long this house of cards can stay standing!!

Just a quick update, doesn't look like I'll be getting May rents anytime soon. My new PM can't even get security deposits right away, we're told perhaps within 30 days of transfer and not to mention they lost some keys. Evernest is treating all owners like institutional owners, let this be a warning to those who are thinking about using them. I have June mortgages payments coming up but they don't seem to care at all. At this point, I cannot wait til they are wrapped up with my portfolio - I'm sure my tenants feel the exact same way!
