He can not sell while you are under contract. You agreed to purchase the COMPLETED home from him. Once he gets his CO you can close but until then he has not fulfilled his obligation. However, if he gets a CO and the closing date passes and you have not closed due to your lending then you would no longer be under contract and he could sell.

I have done this with numerous investors multiple times. We typically give them 2% per draw and 10% on the outstanding loan until the house sells.

When you owner finance a deal who pays the taxes and insurance?

What is the best route to analyze a single family portfolio?  Income approach using a Cap rate?  Sales Comparison approach?

Situation:

A broker sent me a deal of 88 single family properties(~100,000 SF)all on the same street/neighborhood.  The asking price is 6.2M.  Fair Market Value in the area for a single family is $100/sf... thus valuing the properties at 10M...

If I analyze the property by using the CAP rate for the area(area CAP rate for Multi-family is 8%) then the property is valued at $5.3M....

Which should I use?

Has anyone ever heard of an Owner 401k?  What is the difference between this and a solo 401k?

Brian Eastman I am a business owner with no employees. If I were to set up a solo 401k... Could I pay the "solo 401k fund" prior to the IRS taxing it? Or is the contribution taxed prior to being invested? What is the max I can contribute? This seems like I could avoid income taxes and capital gains tax completely. Seems to good to be true.
