Closing on this mold house is tomorrow..I think I have to just ask my agent and see what he says. He is the one who brought this deal to me, so I relisted it with him. He knows well about the past mold issues.

Thanks for all the responses. I've fixed up and sold moldy houses before and my agent never asked me to sign or disclose anything. We always get a professional to certify the mold remediation so I am not too worried, but lets say the buyer does get sick then I don't think I should be held responsible for the disclosure. I mean, how am I suppose to know if I need to sign a disclosure or not? That is the realtor's job as I have no idea how the legal processes work and was never trained. Now that I know, I will mention it, but the houses I had that had mold, the agents can do a past history search and will be able to see there was mold in the house from the previous listings. thanks

I'm sure the AS IS helps otherwise they wouldn't have it. For example, if there was mold in the house doesn't it mean I don't have to disclose it even though it was re-mediated? The AS IS protects the seller stating that if any health problems occurs that they took their own risk from these hidden problems. Obviously if the mold wasn't done correctly then I would take blame, but in some cases the i'm sure it would be hard to figure out what really caused the problem. That's when my defense could be that they bought the house AS IS. The inspector would not be able to know about issues like mold so these are the concerns I would have. thanks

Well I'm sure the As Is addendum helps. Why would all the banks use it? I just want to be protected if there is some kind of mold something dangerous happened that wasn't done correctly by my contractors or something like that.

Here's what happened. When we listed the house, I specifically told the agent that I wanted the house As Is. We accepted the offer, but I didn't see As Is addendum so I asked my realtor and he told me he would contact the other agent. Another week and the inspection passed by, and I asked again and again over 3 time and he said he tried to contact the other agent through "email" but he didn't get a response. Finally, only a week away from closing this other agent (relative to the buyer) and buyer is refusing to sign the As Is addendum. What are we suppose to do here? I just feel like my agent wasn't pushing them enough which is his job. Isn't the Realtor's job to have my absolute best interest? Why didn't he tell the other agent to have the As Is addendum done before we came this far? I've never had any problems with this with other agents as I'm assuming they made sure it was done before any inspections even started.

I understand that, but am I suppose to constantly follow up with the realtor about the As Is addendum (which I did)?

Hello, I recently rehabbed a house to sell and is now pending. When we listed the house, we put in the remarks that the house was sold AS IS. Inspections went fine, and we are about 1 week away from closing, but my realtor only tells me now that he still hasn't received the AS IS addendum yet and the buyer is refusing to sign the AS IS addendum? Who's fault is this and what can I do? I feel like I shouldn't have to worry about this as I specifically told my agent I wanted this to be a As Is sale. Am I over reacting?
