Does asking a question in an ad ie: "Is your money earning you 8%, 10% or even 12% Returns?", and then supplying someone information on Trust Deed/Private Note investing, in violation of SEC Reg 506 D ruling in regards to general soliction to the public? I understand the exempt status for accredited investors...but I guess I'm wondering how does a certain company(first name starts with "Equity" last name begins with "Build") that I have seen advertise in a similar manner does so, and not be in violation. Or am I just off in left field?

Please forgive the question if it has already been asked and answered. I was searching around BP, but did not see anything on this topic or at least the question being asked.

If a SDIRA Investor uses their SDIRA to fund a project of mine @ X% interest. I purchase and rehab the property and then resale it. I pay them back their funds plus interest, is the private investor’s SDIRA now subject to UBTI? I have been reading the IRS publication on the subject, and it does not clearly say to me. Like reading the Bible in Greek. (I have my degree in Biblical Studies w/Hebrew as the major language and Greek as the minor…LOL.)
Can my BP Veterans shed some light on the subject for me?

Wayne Brooks - Thanks wayne. have you had much success working with agents on SS's?

In the BP experience, would one say it is better to work with a Realtor to negotiate SS/Pre-foreclosure deals?

There is a property that a co-worker of mine has listed for sale, and it is a short sale. What has been the experience of investors here when working with a Realtor on a short sale deal?

House – 5 year old Coloinal, 4 bdrm, 2 ½ bth, 3200 sq ft. 2 car garage, nice yard, with large backyard, with screen porch that can be made into a sun room. Located in a cul-de-sac. List price is $225K. There is a new subdivision close by where homes are being built that are smaller in size with 3 bedrooms. These homes are selling for $210+
