Anyone notice that almost every house with a orange "winterized" sticker on it has burst pipes?

Maybe I can get a hold of the banks and get my 5 year old nephew a job, he loves putting stickers on things.

She got me again!!! Fool me once, shame on you. Fool me twice, shame on me!

This time I put in a cash, over the asking price offer in. She made me sign a multiple offer form 2 days later. Ten day later after many calls from my realtor to the listing agent she informs me that she cant' submit my offer until day 15 (first 15 days are owner occupied offers only). We call her back to get the paperwork for a owner occupied bid, and she says its under contract now.

Gotta love her.

Thanks for the input. I called the state licensing office and spoke to a person who hands the Realtor issues. He said basically she can say anything she wants to me to get the sale, or break the sale. If its not on paper, I have no leg to stand on.

I'll mark it as a lesson learned. The part that irks me is that I could have signed it 3 days prior, but she said Monday was fine and I didn't want to make her go out of her way.

I made an offer on a property listed on MLS through a realtor. The realtor called 2 days later and said the offer was accepted. I told the Realtor I was out of town until late friday, and she said I could get the P&S in on monday. I filled out the paperwork on Monday with my lawyer and submitted it. Tuesday she called and said my proof of funds isn't acceptable and I need another copy. (cash offer). A few hours later, she called and said the bank rejected the P&S because it wasn't signed by Sunday the 15th. I signed it on Monday like we discussed. She said there is a new offer on the property now and I need to submit my second highest and best offer. After hours of lengthy heated discussions she basically said, I'm screwed and I don't need to file a grievance with the board of Realtor's because she isn't even a member, so im out of luck.

I ended up throwing a few grand onto my offer, but I guess i'll have to find another.

Any Advice?

I always go straight to the listing agent. My theory has always been that maybe by going straight to them, they will push the bank towards my offer opposed to one from a buyers agent where they will lose 2% commission.

I wish here in New England banks were setting the price low in hopes of it being bid up, but that doesn't appear to be the case yet.

As to my original post, the property was on the market for months, then there was a 10% price drop. There were two offers on the property, my cash offer no contingencies lost to a cash offer $100 more than mine. I wish it was easier to go direct, i don't trust these realtors any further than I can throw them (and I don't think i can throw them very far).

When you put in an offer through a realtor, with a 48 hour response time, is it normal for the realtor to wait until the last minute, get all other offers in, then submit them at once? My last offer was full price and she still waited. In my perfect world, I'd want to see my offer submitted then and there, because its all done through email, or web site anyways.

I told my lawyer to hold off until I let the bank lawyers get back to me so I have no legal council at my fingertips (cheaper this way). Its been almost 2 weeks now, and I still don't know whats going on. My Realtor hasn't spoken to the listing agent as she has not returned any calls since the P&S was signed, but he did talk with her broker, and he said sit back and have a coffee. Too bad I don't drink coffee. Thanks for the reply's.

1 yr ago. A husband and wife's house was foreclosed on.
1 yr ago. Husband signed foreclosure deed.
Last week I signed a P&S on the REO, will close in < 21 days.
Today I saw a quit claim deed from last week where the wife sold the property to a person for $250.
I notified the banks Realtor and am waiting to hear back on what they are going to do.
The mortgage was about $140k
Anyone seen anything like this? I'm wondering how long this will be tied up now, or if it will even go through.

Looked at a REO the other day (single family) and the basement had an empty 225 gallon oil tank that had leaked out. About a 10 foot ring around the tank in the dirt. Floor is half concrete half dirt. I told the listing agent about this and am waiting to hear back if the bank is going to look into it. Will the bank now entertain very low offers as in $1 or maybe half asking price at least? Before I found the leak, the bank had turned down offers of 80 percent asking price from other buyers.

*edit* bank is asking $75,000
