Tenant has been depositing in BofA account. He has been falling behind and I want to require full payment. This is a duplex and I live in one unit. I'm thinking of putting up a mail box for payment. 

If I do how do I stop partial payments? Would I have to return a partial payment?

Tenant has adult son that lives in the appartment. Son is not on the agreement. Do I have to ask for an application? Do I have to add the son incase of eviction?

Thanks all, what I am concerned about is would accepting a late fee that has not been noticed establish any duty on my part in California. I would not add it too or credit it as anything but a late fee if it is not required. As for communicating with my tenant if accepting it is ok, paying it without asking seems to say that they understand that paying late is not ok. 

It is by the way a flat fee not an increasing fee. When I wave the fee I say something like "I wave the late fee if rent is paid by x date."

I like the idea of emailing but not of giving credit if credit is not deserved.

Yes, late fee is after 3 days late.

A tenant paid the late fee even thought I didn't send a three day notice. Can that come back to bite me? 

They are frequently late and sometimes tell me they are going to be late and I waved the fee but I charged the fee in last month but didn't this month. This is in a non-rent control California city.

I know it's paranoid but....

I'm in one unit of a duplex with city curb service. Back unit tenants haven't taken out or brought in the trash since before Christmas, so 3 weeks.  Often the trash is in the wrong can, trash in recycling, and one time oil in recycling(said auto parts store told them to do it). Also work trash(cardboard from contracting job) They were all alone in the back for a wile and I think they must have taken out their own trash and have on occasion actually done it. 

I feel like saying next time the trash is not handled $43.00 more ($10/wk) for the service.
