our tenant broke the lease ... He's been in that house for about 2.5 years ... He was always on default ... Never paid the rent on time... we never charged them any late fee on humanitarian consideration because every time he will come up with some personal issues... But when he said he is gonna vacate the home he had defaults on rent. we have 2 months rent as security deposit , we told them we could deduct that amount on rent only if the house is returned in good condition... when we inspected, the house was in very pathetic state...they didn't inform us about the dog and it wasn't on the lease either but we found that they had a dog and 2 cats...The dog caused much damage to 2 of the doors. But the tenant fixed it by applying some white cement or something and fixed the paint and other wall damages... But the carpet was not steam cleaned ...full of stains and bubble gums everywhere... the lawn was now even maintained...full of weeds...grass almost dead... so we had to put some fine for carpet and lawn...And also for the lease breakage... Now the balance amount is huge .... he said he'll pay some amount this month and will get a document signed by notary to pay the remaining balance in a month. n we agreed to it too .. now he is not answering our phone calls...no reply to text / emails... what should we do now?

I think 30 days notice is only for month to month lease or for tenants at will.

I have rented a house to a tenant and the lease agreement states that 1 month rent + 2 months notice in case of early termination. The current lease ends on oct 31 2014. The tenant has given notice today and since they will be obliged for 2 months notice till oct 4th and the balance days for lease ending is 27 days for which they are asking to waive the early termination fee. I'm new to the rental process, Please help me on how to handle this case?

We found a tenant to our single family house in GA, and completed all the formalities like Lease Contract signed, Move in check list completed and signed, Keys handed over to them and all the utilities changed to their name and the Tenant also moved some of the items into the house. After one week of signing the contract they want to back out due to their another property closing issue. No terms has been mentioned in the lease agreement about cancelling within a week or month other than the regular Early Termination details. Please advice how to proceed about this issue.

I have rented my single family house in Georgia to a person who is employed in military. The tenant has signed the lease which states that 2 months of notice + 1 month of rent to bear the expenses involved in finding a new renter in the case of early termination. Now the tenant has got his transfer order to another location and they gave us 35 days of notice. I'm new to renting a house to military person and I'm not sure of the Georgia law about the lease termination due to official reasons. I need to know what the tenant will owe me in this situation. Help me with the required information so that I could make this process smoother for both the parties.
