Early Lease Termination by a Military Tenant Due to Official Transfer
I have rented my single family house in Georgia to a person who is employed in military. The tenant has signed the lease which states that 2 months of notice + 1 month of rent to bear the expenses involved in finding a new renter in the case of early termination. Now the tenant has got his transfer order to another location and they gave us 35 days of notice. I'm new to renting a house to military person and I'm not sure of the Georgia law about the lease termination due to official reasons. I need to know what the tenant will owe me in this situation. Help me with the required information so that I could make this process smoother for both the parties.

Go here:
http://www.dca.ga.gov/housing/HousingDevelopment/programs/LandlordTenantHandbook.asp
Click on military service members as tenants link on the page. The Georgia landlord tenant handbook will want to open in .pdf or you can save it. Scroll down to page 69 where it has the next 3 pages or so on military tenants. From looking at it the Civil Service Members act trumps whatever you put in the lease and requires only 30 days notice.
I am not an expert and this is not legal advice. Read for yourself and decide.
