There are 2 main considerations when registering an LLC; the state of registration and the operating agreement.

For RE purposes, it is register the LLC in states like NV, WY or DE. These states offer the best asset protection as they recognize charging order's by statute (as well as other various benefits).

It is not necessary, or even preferred, to register an LLC for RE ownership in your home state for privacy reasons. You only need to have an LLC registered in your home state if it is an operating business with employees.

And in this case, I would still register the LLC to own the property out of state, and have an in state Scorp or LLC for operational reasons.

The other consideration is the operating agreement. This is basically the contract between you and your business. In absence of a solid operating agreement, you can be at the mercy of the court.

Someone previously mentioned SMLLC (single member). This is only a concern in certain states and only when you don't have a solid operating agreement.

Hi, my name is Bobby from North Carolina. I have been involved in various businesses over the years and sold my last company in '08.

Currently I run an asset protection consulting firm. We provide domestic and offshore asset protection planning for entrepreneurs and investors from around the globe.

We also manage a private investment partnership.

I have been involved in real estate my entire life as my father ran a construction and real estate development firm. In my early 20's I began buying houses and land, then upgraded to commercial properties.

Currently I only own one house in NC. I sold all of my properties in '07 and '08 as well as selling my company.

I felt the market was a bit 'toppy' and my last commerical property closed in September '08. I then spent the next year living in Eastern Europe.

I am glad to be here and look forward to learning from the members and hopefully can offer some insight as well.
