Not an attorney. But why not just have your attorney prepare a response that your unit does not qualify for Sec 8 based on.... If the non profit continues with the threat of litigation, threaten it with a counter lawsuit for filing a frivolous lawsuit.

You still need to go through an eviction process including giving all required notices and serving papers on tenants (it will be posted on their door after 3 unsuccessful attempts). The process needs to be done in case one of them changes mind and returns. You are responsible to safeguard all property for 30 days. You can either haul everything to a storage or keep it on premises. Everyone on the lease has to release the apartment or be evicted. Also include on paperwork not only tenant' name but John and Jane Dow to cover anyone else who can show up later and claim tenancy. It is pain in ..... But this is NYS.

1. When you are dealing w municipality, try to get everything in writing. If it is not on paper it does not exist. The official you are talking to now may not be around or suffer from "amnesia".

2. If you intend to sell mobile homes, you will run into Dodd-Frank Act. You will need an attorney who is familiar w it.

3. Test your market by placing Craigslist adds and see how many responses you get.
