I don’t know when he would take the loan out. I plan on sitting down with him next week. I would rather the loan be in my name (if there are loans on the properties). I was planning on him finance 20%.

Ideally, I want to do the owner financing 100% through him. He could be the bank.

That being said, he is older and retirement age so I don’t know what he is thinking.

He could want to take the loans out to avoid capital gains tax. That way he could get a larger chunk of money upfront and not pay taxes.

Any more recommendations for my conversation with him next week?

The selling is willing to do owner finance.  He said he owns the rental properties free and clear.  He also mentioned that if he did seller finance that he might take a loan out on the property so he can get cash out if it for the time being.

Is this something people do?  What questions do I need to be asking?

I would need a good real estate lawyer, any recommendations?

I was on Craigslist looking at multi family properties to do a possible 1031 exchange with.  I saw a duplex that I wanted more information on so I sent an email.  A realtor replied and answered my questions.  She also said she could send me a full list of multi-family investment properties for sale.

My question is, do I get a full listing from her?  What if I don't use her as a realtor?  I am new to this and don't want to do anything unethical.

I have a single family home that I've been renting for 10yrs.  I am in the process of selling it and doing my first 1031 exchange.  Can I use a 1031 exchange to buy a duplex (multi family) or do I have to buy another single family home?
