Post: Seller Occupied After Closing

Recently closed on a property in Michigan with the seller maintaining the ability to occupy the house after closing.   There is no specific language in our purchase agreement regarding the transfer of keys. 

Seller is reluctant to provide the keys prior to the transfer of occupancy date.  Though I don't anticipate needing keys and won't experience any damages ahead of this date, I'm uncomfortable with owning an asset that I cannot access in the event of emergency. Hindsight I wish this was stated in the purchase agreement, but foolishly didn't anticipate this being a problem. 

Anyone have any experience? Wanted to check here before calling a lawyer which is where I fear this will end up.

Glad the canned responses worked for you.  Helps weed out the tire kickers for sure. 

I'll save specifics, but I don't think that's a good fit for my community. 

As an investment or way to offset costs, I can't see the benefit with the community garden. I think that would increase hassle/costs to prevent it from becoming an eyesore.

That one crossed my mind. Struggled with the upfront cost for putting in a couple sheds to be available, just for them to sit vacant of the tenants I placed didn't need them.  

Any assumed responsibility for providing secure storage in that situation?

I used to post on Craigslist also, but I never got any quality applicants from there. Most come from Zillow.

I second this one. With Zillow requiring a fee in Michigan now, you need to be slightly more aware of which place you are posting.  Zillow generated most of my responses in Bay City so I'd imagine you'd see similar results. 

Once I see your listing, I'll send you a message to see if you'd be interested in selling. I hear that works. 

MFH under contract with a 0.7 acre lot. The building and the parking lot take up approximately a quarter acre, leaving me with a half acre of vacant land. Rather than this being an additional operating expense in lawn care, what might you do with it to make additional revenue or break even?

The property is in a lower property value area so vacant lots sell for next to nothing, and building new would make no sense.

There's a pretty good presence from other Tri Cities investors here and a meet up in Saginaw that was good on the night I attended. I think it was the last one pre-shutdown, but hopefully the group starts back up. 

If the Saginaw group doesn't have anything in the near future, I think there'd be enough interest with the guys just in Midland to make a go of a meet up.

Midland is a much tougher market for MFH compared to Saginaw and Bay City so you're not alone there. I think that's fairly obvious to say considering there isn't a single MFH listing on the market right now (at least on Zillow/Realtor).  I exclusively looked in Midland for the last year without closing a deal.   

I ended up expanding my area rather than loosening my criteria and have a triplex under contract in the Bay City/Essexville area.  I'd definitely recommend different criteria for each of the Tri-Cities but don't have enough experience to know that I've got it right.
