Hey everyone!

I have a situation that is a first for me the property is in VA. The tenants that moved in a few months ago was a couple. The boyfriend ended up shattering my sliding glass door in a argument and I've been advised that they are splitting and the boyfriend has already moved out(well hasn't been seen at the property for roughly 3 weeks). I want to update the lease to remove the boyfriend. I want to make sure I do it correctly though. My question is can I just update the lease with just the girlfriend or would i need the boyfriend to sign an addendum?? I'm not sure if the boyfriend will sign anything at this point. Any advice is appreciated.

 Oh gosh, I'm sorry!  I read that wrong.  My lease states that all vacate dates are end of the month, so in my case it would be the full month of November.  If nothing is specifically stated, then prorated. 

All good! No need for apologies. I did the prorated amount, but in future leases, I'll definitely add a clause to specify all vacate date are end of month! Thank you for the replies, it's much appreciated!

So the notice given doesn’t mean the lease ends thirty days after the notice date, but rather thirty days after the next rent due date. Of course the two parties can mutually agree to some other arrangement, but normally the lease would run through the end of the next rental period and not be prorated.

Hello,

A tenant will be giving their required 30-day notice to vacate in the middle of the month and is inquiring about if they'll be responsible for the full month or if it will be prorated. I've attempted to read the exact laws required here in VA, but I haven't been able to find anything exact.

These are the exact codes I've found: Va. Code Ann. §§ 55.1-1204, 55.1-1253 (2020)

The gist I've gathered is it's up to me, whether I'll accept partial or not, but I wanted to gather some input from the wonderful BP community to see I'm interpreting it correctly or not.

Unfortunately, there's nothing exact in my current lease and this is a first for me. Going forward, I'm definitely adding a clause that leaves no room for interpretation.

@Michael Jones Ah, that's cool! Those towns are towards the southern boarder of VA, about 4.5 hours South of Front Royal.
