@Pat L. I’m not familiar with vacancy possession. I’m going to look that up now. 

@Thomas S. thanks for the advice buddy. Obviously I am new since I said it was my first property. Obviously I have studied real estate on this blog because that’s what posting and asking questions falls under. 

You are right about what you said I do need to know the state laws and I am planning on reading about this situation specifically in more detail with my realtor. I do know the basics of my state I didn’t think I had to state that in my original post. 

I am not ready to invest because I’m going into it blind with my hands tied behind my back... true. But that doesn’t mean I shouldn’t do it. I can read every book on investing and still not be ready. For me doing it and failing and learning and getting better is better experience than reading a book. It’s exactly having a baby or getting married. Nothing you read will make you the perfect dad or husband but that doesn’t mean you shouldn’t do it. 

I will take your advice and push forward because all criticism is helpful in some way. Thank you for the very kind words 😃

@Wayne Brooks thanks for the advice. What you’ve said is pretty much my plan. It could adjust within the next couple of months but this my plan going in. I just thought I’d run it by the group to see other opinions. 

@Trey Crusey I’m less worried about him trashing the place he’s an old man that just has bad hygiene and I don’t think he is able to realize how bad it is. He’s hoarding a lot of stuff and has stuff all over his unit that’s just not normal living standards. I think his place is nasty which is what attracts the bugs and mice. I am much more worried about him leaving and me having to clean up this junk and finding out that it’s gojng to cost me $10k to fix what he has accumulatively junked up over the past years. Like you said though it’ll be good experience for me either way. I’ll definitely be learning a lot and probably the hard way. 

@Rebecca Panosso yeah I assumed I could do that but my realtor was helping look up certain rules here about how much time I had to give the guy after a new sale of the property. Double vacancy is also another thing. It would slow down progress of renovations especially if we run into any maintenance problems but I think it’s the lesser of two evils only because of how nasty the guy above was living. If his quality of life did not affect my quality of life so drastically I’d rather his money. 

@Dennis M. yeah I’m afraid you’re right. I’ve been feeling the pressures of it lately. She hasn’t been in the property like I have but she always tells me she is on board and will sacrifice a year to help us get ahead. I think that’s just the beginning and once we get settled in I’ll wish I never did. That’s a fear of mine that I am taking head on. 

@Tyler Bushey I considered that option too. I’ll definitely use it if I have any trouble with just not re signing.

Forcing a vacancy is also something I am coming to terms with. THIS GUY HAS TO GO! But, until we get the last empty unit rented, we will still be paying monthly what we are paying now at our rental property. To include maintenance, I'm afraid a vacancy won't leave us with any money for renovations, and we will be in a risky place. I am sure if we get him out it will take us quite a bit of time to get that unit cleaned up and rent ready again which will mean possibly multiple months of vacancy.

Also like I mentioned the original post, I don't think my wife will stay living with this guy here so I really don't have much of an option. These are the things that make this feel risky in addition to it being my first purchase.

@Rebecca Panosso I feel like I'd have to get a tenant in the other empty unit first so that he doesn't ask to occupy the unit not being renovated. But then again he doesn't have to know what is and is not being renovated. 

This wouldn't be considered an eviction right... I don't want to have to go through that process as soon as I get the property.
