Read the purchase contract. In Cali, he can definitely cancel the contract for many reasons. He needs to sign some paperwork and return your EM. I can't believe a lawyer would tell you that you have a strong case. You will need to renegotiate the deal and don't give a dime to a lawyer.

You can also look at the subject from a tax perspective when trying to decide. I personally believe that the ROTH 401K or ROTH IRA is AWESOME. My take on this is to invest in real estate like a drunken sailor in the dips, as real estate becomes more expensive throughout the recovery save as much money in your ROTH and pre tax as possible and buy mortgage notes and do hard money lending deals and save cash for the next collapse. As long as the man doesn't go after our retirement accounts, having a tax free ROTH getting 10-15% looks brilliant to me. For the cash flow investor, it's all about having different income buckets. So my point is use both of them; save as much as you can in a ROTH 401K, invest in funds with the lowest annual fees, and when you switch jobs move the money to a self directed account and invest in notes.

We've invite a panel of 3 professional note investors to share their expertise and experiences from 2016 and how they plan to run and build their business in 2017. We'll have open networking before the event to meet other investors and future investors from throughout Southern California and an open question and answer session at the end for attendees to ask the panelists questions about their experience and business. This panel is only hosted once a year and it tends to be one of the most informative meetings we host. We hope to see you there!

Gerald Lemoine:
As an experienced note investor, Gerald is an expert at acquisition, management and liquidation of performing and non-performing notes nationwide. To date, he has been involved in the acquisition and resolution of over 500 notes with a unpaid principal balance (UPB) of $65 million. With an emphasis on Partnering and Joint Ventures he has achieved success in raising capital and producing impressive returns for his partners. Gerald has been involved in real estate since the late 1990’s, first as a developer, then later with rentals and the purchase, rehab and sale of investment properties. Prior to the real estate business, Gerald was a project manager for a global heavy industrial general contractor.
Matthew Kelley:
Matthew Kelley is the Supervisor of a specialized foreclosure unit, Special Default Services, within Trustee Corps based in Irvine, California. He represents many of the top mortgage companies, Credit Unions, Law Firms and investors throughout the United States. Presently, Matt manages an elite foreclosure unit providing default services to private beneficiaries, commercial lenders and all high liability foreclosures within states serviced by Special Default Services and Trustee Corps. As a guest lecturer and seminar provider, he has advised some of the largest mortgage servicing companies and beneficiaries throughout the United States. On many occasions Matthew has been called upon as an expert witness in the fields of foreclosure, default and loss mitigation. Beyond supervising Special Default Services at Trustee Corps, he is the Asset Manager for Notes on www.bidbiddirect.com.
Ian McColl:After owning a streetwear clothing label through the ‘90s, Ian became a mortgage broker and aggressively bought properties and land through the real estate upturn. After the crash, Ian bought residential foreclosures at the courthouse steps, rehabbed the properties and remarketing them. Since 2009, he has specialized in buying non-performing notes. Ian's company, Surfinvestor Inc., has developed a strong niche market buying non-performing seconds and doing creative workouts with the borrowers. Surfinvestor Inc holds its performing notes long-term for great cash flow. They are also currently obtaining residential properties through foreclosure and keeping them as rentals.

About Kristyn:
Kristyn was born and raised in San Diego, California and studied at Grossmont Community College and San Diego State University, and has worked with industry leading companies such as BNC, Lehman Brothers, Accredited Home Lenders, WAMU and Chase. She has an extensive background in Procedure Writing, Training Facilitating, Processing, Underwriting, Loss Mitigation, Loan Servicing, Mediation, Bankruptcy and Foreclosure. Coming into the industry in 1998 as a loan processor, she quickly moving up in the ranks to Management. In 2007 due to market trending she transitioned to Servicing and Default for Chase Home Finance. During the 7 years at Chase she spent 3 years as a corporate Trainer specializing in Income and Underwriting. The remaining 4 years was spent in Loss Mitigation and overseeing the Active Bankruptcy Portfolios on all platforms.
