@John Powell if it is slated to be a rental, then fill the pool in.  Unless it is truly an A class property with A class tenants who will take care of it, and even then its doubtful.  Shore up your lease (attorney reviewed) and buy a lot more liability ins if you rent out a home with a pool.

It's this sort of dumb thinking that gets politicians making more and more laws that make it difficult for the rest of us.

There was a discussion on BP a few days ago about unenforcable clauses in contracts, and what you've just shown is one of them, and you are also demonstrating contract of adhesion incredibly well. You are making terms in your contract that would make the contract unequal, by incumbering the tenant with the cost of moving at a time they could not easily afford to.

Suck it up buttercup, until they owe you money, you are stuck with them. 

 Neil, I took a look at your profile.  For someone whose holdings apparently include office, retail, commercial, multi family and sfr, you sure are spending a lot of time worrying about things that have not even happened.  Do you treat your "commercial and retail tenants" with the same arrogance you are displaying here toward your "poor" sfr tenants who you think are likely to lose their job any day now? I feel bad for the people that rent from you.

 Maybe it's a Cali thing, but your tenant should handle the landscaping imo. My inlaws always included the gardner in their rentals out there and I never understood it.

Depends on how long you are planning to hold, the condition of the trees and how likely you think a storm is to take them out.  Here on the east coast, hurricane winds will bring one down, even several hours in from the coast.  So I would either factor in the cost to remove or at least have a comfort level that they will not cause future problems.  That at least is what I would do, but thats because I have seen 3-4 fall in a storm in one yard. 

Edit:  i just re-read to clarify. 4 foot diameter? Nothing good comes from that in my opinion.

 Thanks for the reply Sue. I should have mentioned that I looked online fairly extensively before posting.  The one Signature has out is an older version, which is also what I found elsewhere.

Would someone (a realtor I assume) with access to the NC forms share with me the most recent NC Standard Form 410 T as well as the pet and maintenance addenda?  The version I have is a couple of years old and I believe 7/14 or so is the most recent version.  PM me if you can help.  Thanks

thanks for the laughs everyone. Funny thing is that my tenants' pets have never done anything like this, but mine did.  Fortunately we are moving this week...new house has hardwoods throughout.  This one will become a rental and I will likely go with vinyl plank.

Looks like something a tenant would leave behind, right?  Nope.  Apparently my 4 year old spilled some of his drink on the carpet. It wasn't cleaned up all the way and the dog did this trying to get to it.
