Hi Everyone

What laws cover contracts with contractors in California? And are there good resources covering these laws? The contractors to be covered under these laws are roofers, remodelers, ect.

So a tenant gives me notice to move out on the 15th. On the 16th he still has left all his furniture there while another tenant is slated to move in on the 16th. It is legal for me to move out all his stuff into storage on the 16th to allow the other tenant in.

Lets say a tenant gave notice, but did not move out their belongings on the due date, preventing another tenant from moving in. I believe in CA I may move the stuff out and put it in storage, correct? Have any of you had to do this and did you use a regular moving company to do this?

I have a month to month tenant that may have to be evicted for breaking apartment rules. Lets say I serve one month's notice, and after one month the tenant does not move out. Does one still have to file an unlawful detainer, or can one get a writ of execution immediately?

I have been informed by my present loan officer that the major banks do not offer construction loans anymore. Has anyone here obtained a construction loan lately? We are looking to tear down a 5-plex and rebuild two spec home on it.

Post: Forms for selling house/property in California?

I am thinking of selling a rental house in Southern California by myself. An escrow recommended I use CAR (california association of realtors) forms, and I would agree they would be the safest. However they are godawful expensive, $200 for a pack of twenty residential purchase agreement forms, and so many different types of forms might be needed, such as counteroffer forms, contingency release forms, ect. Now I know one is not legally required to use CAR forms. Has anyone here sold a house or property using their own forms or forms from a different source?

A developer is building a cinderblock wall next to our 4 plex. The property line on his blue print looks like it would give us decent space between the fence and our building. However if they build the wall closer than the blue print, it will be bad news for us.

We are looking for a way to find recourse in case by accident/intent they build the fence closer than they are telling us now. We asked for a "Certification of Property Line", which is supposed to protect us, and the developer agreed to give us. But we called the Orange County recorder, asking how to record it, and they said they don't know that form. Have any of you used a "Certification of Property Line"?

Our agent now wants us to remove all contingencies except loan contingency. He says even though some repairs aren't done, even with removal of inspection contingency, once seller has agreed to do repairs in request for repairs they are almost always done eventually.

Our loan is 'conditionally' approved. So is it safe to remove the loan contingency in our escrow? Or not?! I know after contingency is removed our earnest money is toast.
