Trust me if it was a few dollars, I would not care. It's significantly more than that.

I think your right. I think I'm just going to have to let the broker have his peice. Honestly I wouldn't really care if I was at a standard brokerage here in Michigan where the commission is a 10-15k cap and perhaps a small royalty, but because this is an odd brokerage, the split on this deal is 60/40 for every single commission dollar. Ouch!

Sure, but if I terminated my license and called the fee a consulting fee, the I'd be able to retrieve the money free and clear without a split.
Because, to the best of my knowledge, it seems that what I am doing doesn't require that I be licensed in the slightest.
I just don't feel that it is worthwhile to pay my broker for a transaction that doesn't really require his services or protections.
But yes, I shall talk to my broker about it.

I suppose here lies the crux of this question. Am I truly brokering a deal?
From what I can understand my purpose it to simply find an investor who is interested in entering into a deal such that they will bring about a great deal of money in exchange for equity in the development.
I am not representing the buyer in anyway nor the seller. I am not negotiating anything.
In fact once, I find a potential investor, I am not delving into the details of the transaction or providing presentation of the opportunity.
in essence all I'm doing to is a quick screening of potential investor, and then telling the developer to present his investment opportunity to this guy.
My role in this transaction is done after that. In fact I do not have to wait for the development to finish to get my "finder's fee". I simply wait for the investor and the developer to come to agreement.

Here let me give you a little bit more detail.
The investor would become an equity partner in this this transaction. So yes although some Real estate is being transacted. This is more of a business investment.
The investor will front a great deal of money for some equity in the development.
Would you still say my broker is entitled to a split on this?

I will not be signing any type of agency agreement with the investor. Nor will I be negotiating or writing contracts on his behalf. All I am doing is finding the investor and having the owner of the development do the rest.
I will be signing a fee agreement with the developer though.

Hi friends,
Here is my question. a friend of mine has a fairly large real estate development deal he wants to market privately to large investors.
He has asked me to reach out to my SOI for a potential investor. IF I find him an investor, he has said (and written in contracts) I would be entitled to a fairly significant finders/consulting fee. Also note this development is outside the state where I hold my license.
Now as a licensed realtor, do I owe my broker any part of this consulting/finders fee?
I would think not, but I am not certain.

Most builders will not move on price because they don't want to hurt the comps, but they are much more likely to give you some free/discounted options.
