i have a property I am buying in CA, Dad died, Left behind a wife, and Daughter from another marrige. No will present.

House is valued at around 130k

Does it need probate, or can we file Affidavits of Heirships and do it that way?

Yes title search was done, all heirs were traced down and agree to sell, but out of no where one does not want to sign now. I think we can work it out. we have 3 of the 4 signatures.

OK so put a property under contract, went to get affidavits of heirship and now they are stalling on selling the house. On the TREC form I have already got 3 of the 4 heirs to sign. Mom- now deceased didn't have a will. I still want the property. File a Memo? or since mom is on the property I need affidavits do file one?

Hi all, I have a property under contract.

Title company discovered $14k in judgments, they are trying to see if that amount is correct.

- Is there a way the seller can back out if he decides not to pay them? Im not sure If he can foot a $14k bill

-Can the title company structure it in a way that the payment come out of his proceeds upon closing (he will be profiting from the sale even if they take it out) 

Let me know my options as I feel that this title company is a little inexperienced in problem solving.

My neighbor (commercial property) SAME LAYOUT, SAME SIZE, Refied his property for $500k in 2007. Is it safe to say that if a bank was willing to do that in 2007, (located in a prime area) that they are willing to do similar with mine? 

so I went to sign up for TLO Experian, I have a legit corporation so thats not a problem, good credit ETC. they said since July 1st they are being so strict about access. How are you guys able to still get it? any other websites that provide the same or better service?? 

but anything can be added I suppose? His attorney also reviewed and no red flags arose. 

He would not do that. Tried lease back, owner finance, purchase outright, this is the one the floated his boat best. just one of those deals! 

No it's in writing that ot must be offered to me first for 450k commercial is different In TX than residential
