Thanks @JD Martin , That is a good point about are they even worth it especially when you consider the roots. The property has about a quarter mile of street access, and no trees or anything to block it, so I wanted to put something there to give a little privacy anyway, and then these trees obviously have to go, so I was hoping to re-use them. But you bring up good points about whether they are the ones. I never actually purchased trees before so I don't know the cost.

@Peter Mckernan Thanks.. But since it is a flip or a rental, it probably would not be worth getting it professionally done like that. I have a friend with a skid steer, and if we can't do it it's probably not worth it!

I know I am late, but I figured I would update. Ended off just simply putting a carpet over it. I got lucky and a tenant eagerly wanted to rent the entire building, and they were perfectly cool with a carpet over it. Thank you everybody for your opinions!

Hey all. A question for those who know much about landscaping.. Looking to buy this property. These bushes are clearly too close to the house. Is there any way to move them? Are they worth digging up and relocating? I would like to bring them closer to the curb, but if I can't I will just chop them down. Thanks!

Wow. After reading all these comments, I think either I have a really in-demand post office or I am just an excellent negotiator! They came out of the gates offering me about a 33% increase in what they were paying, and I settled for a 60% increase.

Any suggestions for this flooring? We have this approximately 4 in wide “trim” along the perimeter of the room. It's basically a 4x4 that goes all around, and they must have poured the concrete into it, but left the wood. And the wall is built on top of that wood. It's pretty crazy. If I did carpeting, there would be a bump there. Originally I wanted to do painted concrete, but that would leave the perimeter sticking up. And it's not level all around the room, in some places it's a quarter of an inch higher than the concrete, other places it's almost a full inch. The goal of this room is to become a small event room. I'm pretty flexible with what flooring goes down - Carpet, sticky tile, painted concrete, etc. Just not sure what to do with this lip all around the room.

Have you asked your tenant what they want to do? If it is a good tenant, your priority should be to keep the tenant. *That* tenant is the most important thing, don't worry about the next one. Are you looking to raise the rent if they stay? Usually about 45 days before the end of the lease I will just send them a text, something like “Hey. As you probably remember, your lease is ending on June 30th. what are your plans? I'd like to keep you! I would just have to raise rent just to $1,600, which I think is still below market price. Are you interested in renewing your lease for 12 months?” I've had people come back and say well we only want to be here for 6 months.. so then I put them on a 6 month lease. And at the end of that 6 months, they wanted another 12 :-) So talk to them.. find out what they want.. and work with that.

@Nathan Gesner Yeah you are correct.. I know they are professionals at using the system. They already talked about getting attorneys involved.  It's just hard to mentally justify, when they are paying rent. So I'm going to spend money to get a lawyer in order to shut off a stream of income.

@Tom O.  Thanks.. Since they are inherited tenants, it is not my lease. But that is a good idea for the future! Yes, New York is tough.. I have gone through evictions successfully. But this is such a weird case where they want to stay, and they keep paying, but they have done so many crazy things.

Hi all. Just looking to see if anybody could point me in the right direction.. Without me having to pay tons of money to a lawyer to do an eviction.

I bought this duplex in April in upstate New York. It had two tenants. Both paying way below market rent, but that's a different topic. Both leases expired a year or two ago. Upstairs people I got them on a lease, no problems, great tenants. Downstairs people, giving me, my workers, and the other tenant a hard time. They did not want to sign a lease. So, I am looking to have them move out. Gave them notice, waited the time period, and they did not move.

They continue to pay rent. They gave me a check for this month, but I am not cashing it. I want them gone.

New York state has an interactive legal document thing to make this supposedly easier. However, their website says the following.. and I am confused as to the difference between bringing a proceeding and starting a case. Anybody know the difference? Any other advice? Thanks

“This program is not for you. If the tenant has not given up possession of the premises, you can't bring a licensee holdover proceeding in court. You can start a holdover case against the tenant.”
