@Chris Cambridge Yes, I am okay with that. I want to refi now to take the cosigner off. But I am confident in a year I'll be able to refi again with lower rates if need be.

Hey all! As a REI amateur, I need some advice/insight into how to go about my father's lending situation. In essence, our primary residence has a cosigner on the loan we are trying to remove. The principal is $253k-ish. Value of the home is estimated at $375-425k. In addition, we have a commercial loan (not a mortgage I am pretty sure), with a principal of $220k, that we used to purchase two investment properties. In total we have six investment properties (worth $125k each, or $750k total).

The main issue with refi I think will be his income. He took a hiatus from work for a few years and is now back to working. He opened up his own business and it is doing well, but it has just been a year. I do not know if banks will consider this income due to the length of the income. If they do, at even 50-70% of net income, we would be set. Is there a way around this with self-employed people? Does a guaranteed payment change anything? 

Also, how else can this problem be tackled? I was considering perhaps refi-ing and taking money out of the investment properties to free up capital and use it to pay down the residence mortgage and hopefully he can get approved then. I am very, very new to this but he has little understanding of the language or real estate, so I am trying to help him navigate through all this. We just got the six properties last year through a 1031, so if I could do that, I am hopeful about this! Thanks in advance to the BP community! You all have already helped my family so much.

My father is currently trying to refi personal residence to remove a cosigner from the current loan that started in 2011. Does anyone have any contacts for lenders in the South Jersey area?

@Kathy Henley would it still be considered a disregarded entity and would the taxes still be filed under the owner?

Hi all. We are in the middle of a 1031 exchange currently. To statisfy the same taxpayer technicality we opened a single member LLC that is disregarded for tax purposes. However, now without an EIN we are having trouble opening a bank account for it. Is it only possible to open it under your personal name and DBA affiliated with it? Or is there a way for a disregarded entity to acquire a bank account and credit card under the LLC? Thanks in advance!

My father is in the process of selling a property in North Jersey and the closing is hopefully going to be in the next 24-48 hours. Is there any 1031 QI Agency who would be able to work in that timeline? Extremely last minute but don't want to miss out on the benefits of the exchange. Please only refer agencies you have worked with.

Have some experience with this: In 2001 we bought a home that was sold as a triplex. At the time, family was new to America and just bought the home without due diligence. Same situation as you describe; there were three of everything. In 2017 we get a citation for an illegal apartment. Apparently the c/o had been for 2 families. However, the four other houses in the same exact situation as us haven’t been cited. Just find out how lenient the city is before hand with this stuff and see what the process to make it a legal four family is. For us, the town basically said not going to happen because shortage of parking....this is north jersey by the way.
It probably depends upon the state, but in NJ it does.
