I am planning to open a solo 401(k) plan for myself and maybe my wife as well. Our goal for the solo 401(k) accounts is to 1) tax shelter tax for money we make from flipping houses; and 2) use the money to fund our future flipping deals. My question is how to structure my future flipping deals with the solo 401(k) accounts involved? Below are the scenarios I can think of:

1. Our Solo 401(k) will fund 100% of acquisition and rehab. In such case, all profit goes back to 401(k). The profit will also be subjected to UBIT tax. 

2. The solo 401(k) account will fund part of the deal, say 20%, we will personally fund the rest 80% with our own money. Profit will be split at 20:80 ratio. The 20% of profit that goes to the 401(k) will be subjected to UBIT tax.

3. The solo 401(k) account will fund part of the deal, say 20%. We will have a partner to fund the rest 80%. Profit will be split at 20:80 ratio. The 20% of profit that goes to the 401(k) will be subjected to UBIT tax.  

No. 1 is probably the simplest deal structure but is not going to happen anytime soon as it's going to take a well before there is enough funds in our solo 401(k) accounts. My question is that if No. 2 and No. 3 is possible?

@Eddie T., it's engineered hardwood floor from lumber liquidators. I believe it's hickory.

Here are the approximately numbers:

Acquisition: 300k

Repair+holding: 85k

Sale cost: 35k

Sale price: 476k

Agents and investors, is a in ground pool a plus or minus to potential buyers in the Seattle area in general? It's an entry level house (sub 500k) with moderate size lot (~6,000 sf). The pool literally takes more than half of the back yard for the particular house I am looking at.

Personally I think a pool in this area is more of a burden - it only gets used for 2 months each year.

I normally get at least 2 to 3 bids and pick one. So for me it's always by the job not by hourly rate.

The best thing LLC provides you is asset protection. It separate your personal asset from your business.

@Ariel Goldenberg, As you said it's really depend on your personal situation, your goals, and what you see the future market. Do you have better avenue to invest your money? Can you find a better property to 1031 into? When do you think the next recession will come? How much do you think the real estate market will fall when it happens?

I believe many investors who own rental properties in hot markets like California, New York, Seattle etc. are having the same dilemma as you do. I'd say this is a good trouble to have: you make money no matter which way you decided to go.

Between 3 and 4 you would want your title company to do a title search.
