Thank you for offering to answer questions.  Do you know if I can sell my residence after using SB9 to split the lot?  I will be selling the second lot to an owner occupant.

Hi Brandon. I've been reading up a bit, consulting with civil engineers, and contacting the City of San Diego on SB9 but I am by no means a professional. I am curios to find out more about your question. Do you have a vacant lot or a lot with a building/SFR on it? What do you mean when you say the lot will NOT be split? Are you just looking to build an ADU?

Hello Everyone.  When using SB9 to split a single family zoned lot into two lots there is an occupancy requirement of 3 years from the time of the approval of the urban lot split.  I understand an affidavit stating "I intend to occupy..." must be signed in order to obtain approval.  My question is- what if life circumstances change and I need to sell the owner occupied portion within that 3 year window?  Can I do that?

Additionally, what if I sell the extra lot to an owner occupant and rent out my units.  Is that acceptable?

Any responses from California SB 9 savvy people will be greatly appreciated.

I have a property with an easement held by the Southern California Telephone Company dated 1943.  My understanding is this company was purchased by ATT.  The easement is inhibiting the usability of the land.  Does anyone know how to get ahold of ATT regarding this matter?  If not, then does anyone have any advice on how to get this vacated or moved?  Thank you very much for you time.

Thanks Kristi.  Great break down of your thoughts.
1. I completely agree and have conveyed this to the seller and he didn’t tell me to kick rocks so there maybe some negotiation capability.

2. I’m working on that exactly

3.  I didn’t think about that. I’ll get a couple structural engineers to take a look. 

I like the perspective of looking at it like flat land. I talked to an appraiser who would put flat land around $100 a Sq foot. To get this graded and retained I anticipate $30-$40 per sq foot. I guess that’s close to where the deal pencils for the land minus the unusable portion due to the fault line.  

I’ve actually been working through this quite a bit. Your questions and input are helping me solidify my stance as I type. So thank you. 

I’ll report back with any other findings or details.

Craig, thanks for giving me your view.  I see houses built all around this land, just happens that they were built prior to the institution of this geo tech exploration and new information that the fault line “might” be active.  It seems like “ignorance is bliss” may apply to this situation.  Anyway, now I know and I need to make an educated decision.  Your information definitely help as.  Thanks again.
