Would it be best to put the property in an LLC or trust? Also, what are the funding requirements for a second home. I know my first home was specific on where the down payment came from but I am being given the down payment for this vacation home. Will it be an issue with a relative providing the down payment?

Hi BP,

I have a primary residence in Massachusetts and am looking to pick up a second property in New Hampshire (White Mountains region). My original mortgage broker that assisted with my first property told me to do a personal loan for the vacation home. Are there any other options or would this be the best course of action. I would be looking for a fairly cheap place between 40k-100k that possibly needed some upgrading but no major rehabs.

I would agree that you consult an attorney. Underground oil tanks, if the property is not aquired properly, may allow you to become liable under the CIRCLA and superfund laws

In Massachusetts the landlord is responsible to remove snow on any common area. If a duplex has separate entrances then the tenant the tenant can be responsible. If it is a common entrance than the landlord is responsible. You can however increase the rent for the tenant and do a rent reduction for the months that the tenants does the snow removal but you cannot require a tenant to remove snow from common areas.
