Thanks all for the advice - I was more interested in where this lands from a responsibility standpoint and from what I'm reading this feels more landlord than the tenant if the tenant feels the need to call it in.

Thank you for the comments on self-managing, it would be nice if I was local and could simply drive out and do that, but alas I am half a country away and the PM reduces my headaches. I could've probably found a contractor to do it for slightly less, but as I said that wasn't my main concern here.

thanks @Leo Koonan there have been a few small charges, but I’m having a hard time determining if it’s the PM or if I just got a needy tenant. I’m leaning latter.

I appreciate the responses, I’m still relatively new to rentals.  I had considered the liability issue as well, but hadn’t considered city ordinance. I just wasn’t sure if this scenario fell under one guideline or another or if anyone in the Denver area knows of specific rules. Thank you both!

Greetings, I started to hijack another thread before I realized this is my own issue. My PM in Denver recently had a significant charge on my statement for a wasp nest removal ($200). Ok, The amount is high, but things like this are so it's not my main concern.  

The thing is wasps are quite common in Denver and when leasing the property I specifically elected not to pay for any sort of regular Pest control for insects and bugs, such as Orkin, etc. 

On the lease it states as follows: "Lessee is expected to maintain and care for the property, which includes, but is not limited to the following: Pest control including but not limited to mice, ants, small rodents, etc."

When I asked for clarification from my PM they said this clause only protects against something the tenant can control, which makes no sense to me since many pests aren’t preventable, they just happen.  Should I press this with them? Clearly, my tenant could have spent $5 or less on a spray or trap - I wouldn’t even mind reimbursing that purchase, but I didn’t cause the wasps any more than the tenant did. Curious if I’m in the wrong here or not.

Just re-read my lease again and definitely going to press my PM company it says this: 

"Lessee is expected to maintain and care for the property, which includes, but is not limited to the following: Pest control including but not limited to mice, ants, small rodents, etc."

I definitely feel like this is on the tenant - bees/wasps are common, especially in Denver. As far as this topic goes I don't think landlords should automatically assume responsibility for pests unless it is missing or specified in the lease agreement.

I am very curious about this subject.  My PM company suddenly charged me $200 to take care of a nest on one of my properties. (I don’t even want to get into the exorbitant rate).  I’ve emailed them, but I don’t see this is my responsibility. I’m not paying for Orkin to come out and treat for spiders regularly and I don’t see this any differently as they are both considered pest control in my mind. Am I wrong?

I didn’t end up needing to borrow from Merchants but I have to say the whole team was extremely pleasant to work with in the pre-approval process. The terms seemed competitive for the industry and my research pointed to them as one of the best. Good luck!

Sorry Simon, bit of confusion as the moderators thought I was promoting myself. I have a rental just outside Denver and I just recently started using Real Property Management Colorado and so far I’ve been pleased with them. They are new to me, but they came recommended from a family member who has been very happy with them for about 2 years. I really like that they do quarterly walkthroughs in the property and take pictures.
