Most lenders like to see a lot of skin in a deal, and you might check with an HML to see if they offer better financing.

I can only speak about Dallas's county Texas where judges will toss clauses if they think it is one sided.

I think you will be better off finding a mom and pop title company, and you can save a lot of fees.

If you decide to use an RMLO make sure you get references and a copy of their business license and insurance. When Dodd-Frank roll into town they have been a lot of clowns setting up shop calling themselves an RMLO.

It is good you go line by line with the tenants but all the clause you add to the lease can get thrown out when a tenant sues unless the judge allows them.

You can tell the 2nd to pound sand, but the buyer cannot get a clean deed until the 2nd is paid and if the 1st is only $6K, the 2nd can just pay the 1st pennies on the dollar for a lien release. If they get a judgment, they can attach anything he owns. He should try to work out a payment plan with the lenders.
