Thank you for your professional advice, I really appreciate it!  As far as an adverse possession that you speak of, does that only come into play if that is the only way to get water to his property? There are multiple ways for him to get water, he has a 2.5acre lot bordering 2 other city owned streets (my lot is only .24). I checked with the city water and there is city water running along those other streets. He could also run it along his own driveway to the street...or the 3 other neighbors yards (as he seems to prefer to dig up someone else yard vs his). Also our lot was once a larger lot subdivided a few years ago, because he cant remember where it was installed....technically today it could be on the neighbors lot. He has done nothing to confirm/locate the lines only complain. Sorry for the long post/rant....I do appreciate your feedback! thanks!

Hello all! We just finished rehabbing this property and the back neighbor comes out to tell us that his water lines go across our yard. He is claiming a leak and needing repairs. There is no easement or legal documentation in the deed. The neighbor says he made a friendly agreement with the elderly lady that we bought the house from some 30 years ago! The neighbor cannot even remember where his lines are. I am under the impression that because there is nothing in writing, we don’t have to give permission? Could his water be “grandfathered” in? He is making some claim to that effect. I contacted our attorney and apparently the neighbors attorney is getting involved. Is this worth retaining our attorney for? Or come to agreement outside? The neighbor has yet to even confirm that his lines are there.... he does not remember the path. We built an addition on that side of lot and never came across water lines. We told them to ask the other neighbors for access, which Im assuming they said no. We would prefer no lines on our property as it deters buyers and even with an easement it is less attractive. Or charge a larger amount for easement(?) Anyone familiar with this situation? Any advice? What rights do I have? What rights does the neighbor have? We bought this property on the mls with a realtor and nothing was in disclosures, nothing in deed. Ps- Our property is on the market! Another reason we don’t want him digging up our yard. There have been other issues with this neighbor, ....they are very emotional driven! Help!

Located in HOT north Asheville neighborhood. Near university UNC Asheville and 6 minutes to downtown.

Asking- 225k

ARV- 400k+ (depends on how you renovate)

rehab$- 50k+/- (depending on how you renovate)

60's style raised ranch

-1,360 sqft on the main/top level- Nice floor-plan with 2 large bedrooms, 1 bath, kitchen, dining, living room, second level patio/porch.

-Additional 1,360 sqft on the lower level (lower level is above ground) Could keep one portion as a  2 car garage and finish out other half to gain 2000 sqft, or finish out all and gain 2700 sqft in North asheville!

This property has many creative ways to renovate to flip. Could have in- law suite, home office, income producing apartment, possibly a duplex (need to confirm). This is a  solid house!

Hey Robert, I have used a couple different attorneys in Asheville. I personally like smaller firms as you get a more personal relationship. Clement Law is my recommendation. Eva is great, she is very reasonable, easy to communicate with and very helpful. I can also share which firms to steer away from. Feel free to PM me. Hope this is helpful.

I am a rehabber in Asheville. Its a tough market if you don't know your neighborhoods, as they vary drastically! Rent prices are high and there is not enough housing in general to support the growing population. New builds are through the roof right now ( pun intended:)) This creates a lot of competition. 

There are some areas that are turning and would make for good rentals as the house values are not as high as others, but still close to downtown and therefore high rents. Also because the market is climbing, look slightly outside city limits as the more affordable housing will continue to get pushed further out.

I am in/viewing properties constantly! You really have to in order to get familiar and as @Chris Harjes stated...."its a little nuts out there lately" Its spring/summer fever and everyone wants a piece of Asheville.

Hi BP!

I am rehabbing properties in the popular Asheville, NC area!  Looking for private lender/partner.

I currently have 2 properties under contract. I have been working with one private lender on my past projects, but would like to expand and keep growing! I have a couple different strategies lined up for these particular properties. Land is super hot in Asheville as the building industry is booming. One deal- has a couple of different potential exit plans...ideally, Im looking to subdivide, sell the lot ( have potential  buyer/builder lined up for lot) and sell the house as-is as a long-term rental or rehab. Or fix up the house ourselves and sell arv 435k-475k (dependent on lot size).

Second property plan- buy 300k put in 35-40k ARV 415k-425k

Both properties are in the same neighborhood, about the same size (1600-1800SQFT). It is a popular area, with a mix of houses,  small houses mixed million dollar homes.

We currently work with a great realtor, who also invest in RE, rehabs properties and knows the market well! Im on the phone with them 5 times a day, we have a solid relationship. Also have a good team of licensed professionals lined-up to do work.  I have a growing network of other rehabbers, wholesalers, and builders. I work directly with our attorney for closings and run nearly every contract by them.

Our business reputation is very important, we take great pride in quality work!  I welcome challenges (as they come at every corner) and continue to grow from them each step of the way. We are looking to work with like-minded individuals! Local or from afar.

We have actually been looking at different greens and greenish-grey colors. Didnt necessarily think of the hickory trim though. We shall explore that more! Thanks for your feedback and tips, appreciate it:)

HI BP!

We have been debating over an exterior color scheme for this Dutch Colonial style house. We have not completed the front porch, but this picture should help give a good idea. 

So far, I'm thinking a darker color, to make for "covering" the existing paint easier. We are back forth on white trim vs. off-white or cream. The neighborhood really has a mix of colors... from kinda crazy bright colors (purple, bright green and even orange), to the more usual neutral tones (gray, tan, green/gray). The style of the house shows a lot of roofing...therefore coordinating off the shingle color is our thought. Or is that too much grey!? Also- I have seen that it is common to have a different color on the upper dormer side (side of the house portion near windows) of dutch colonials. Any thoughts?

 And... what to do with the two front facing windows on second floor... adding a contrasting color to pop?

I would love your advice.... a big thank you!

Defiantly keep me in the loop for when either of you are around Asheville. I am back/forth NC to VA nearly every week! I will be there in the beginning of January and fully engulfed in rehab in February:) Come check it out!

Austin- the fix/flip was on the mls. it is a older home w. carriage house near montford and chestnut ( higher value) neighborhoods. It will be a tough one! Not your "average- run of the mill rehab" ( if there is such a thing). But the numbers spoke, and we took that action step!! Now we are learning how to "deal with the city" and keep contractors on task/schedule, and keep investors(private lender) happy....easier said than done, but are doing it!! So, you are marketing  in between Asheville and Whittier, correct? Im not as familiar, but interested ....let us know how it goes! :)
