Post: Question about deed transfer in Indiana

There's one section on the deed paperwork that I'm not sure about.  After the "Commonly known as", "Parcel Identification", and "Source of Title" there's a section that reads "THIS CONVEYANCE is made subject to:"  What is suppose to go there?  I can't find anything in the instructions on the paperwork that might elude to what that is.  Anybody know?  Source of Title would have to be found out from the records office that recorded the deed last, correct?

First 2 questions I have are: How old are the collections and how old is the company? Was this a recent startup in which he's made a quick jump in salary recently or has he made this amount for a while? If he's made it for a while you're looking at someone who doesn't care if his bills are paid on time. If it's a recent jump, do the collections timeline look like it could've been incurred from trying to get the business off the ground and he just hasn't got them paid completely yet? New startups with a quick jump in salary make me nervous.(think bottle rocket) There's a lot of volatility in that. Some more dot connecting might be in your best interest.

Depends on who carries the eviction out.  The paperwork does say that the property has to be vacated, but also clearly states that the people on the eviction order have to vacate.  If you get the officer that wants to read the order to the letter, it can become an ordeal.  Our Judge in this area is a people person(even when you don't want him to be) so he's a little more lenient with giving renters time to get out. I would assume there would be a general order that could be served without naming specific people, but I knew who they were and the judge being a people person always wants to give people time to go, even when he shouldn't.  Small town politics, I suppose, we don't have too many homeless people in a town of 7,000.

Thanks for the advice and the reading material. I actually have a specific time line in place, just didn't mention the particulars. My expansion actually got fast tracked by about 6 months. I sign paperwork on a house this weekend and my attorney will be transferring the deed starting Monday. This will be my 5th rental now, so hopefully have 6 by the end of March now.

You never know anyone until you try to get them to move out of your house. Found that out real quick.

The way it works around here is any guest or visitor that comes to the rental home that does any alterations or damage to the home, the person on the lease is liable for it.  That being said, you said he wasn't on the lease...if he's living there, you better get him on it.  I've ran into this with "professional housing scammers"  This is where: Adult 1 and Adult 2 move in, on the lease, then invite mom and dad and their other 2 kids to come live with them, they don't go on the lease. We let it slide, couple months go by and rent stops coming, we tell them to get out(legal steps, of course), they refuse, we have to evict them, they fight the whole way in order to maximize the time they get free housing.  When the eviction finally comes through and they leave, guess who stays...that's right, mom and dad and their other 2 kids.  They weren't on the lease, therefore weren't on the eviction order.  So, now they have squatter's rights and we legally can't remove them from the property without going to court YET AGAIN, to remove them.  Lost 4 months income off that property because of that.

I haven't had too many good experiences with landlords, but the worst I can remember was 4 years ago.  My wife was home alone while I was working and she stepped out of the bathroom to see movement in the bedroom, so when she looked around the corner, the landlord was sneaking back out the back door.  This was the same one that refused to fix a leaking roof that was leaking water directly on the breaker box in the house.  We didn't stay there too long.  The thing I hear from my tenants that they really like about me is that I'm approachable.  They know that any time, for any reason, they need to talk, they can come hang out and chat with me.  I'm a normal guy, I like my guns, I like my hunting, I like my trucks, I drive a truck for a living, and I know that stuff happens and sometimes you just need some company.  My renters and I have sat around the firepit telling stories and laughing for hours.  Sometimes just being a decent person means more than money ever could.

 That is very Dave Ramsey-esque. He's been a big influence in me changing my life around for the better.
